Police Protocol?

Would the Police take your mobile phone off you (to check if you were making calls etc.) and take your vehicle away to be weighed if you were in an accident that was’nt fatal?

I’m just wondering if they only do certain things if an accident is fatal

The police officer just needs to be able to justify his/her actions.

May not be fatal at time, but could the outcome of the incident become fatal. At the moment there only seems to be you with that knowledge :astonished:

Indeed… “MAY” being the important word… so that’s always - potentially.

Some forces will automatically breathalyser you and if there’s are injuries, they’ll arrest you and keep you until they are happy about your identity. Cops are very long in the tooth when it comes to people trying to pull the wool over their eyes.

Best cooperate fully IMO. More you wriggle - the tighter their grip.

Senior traffic officers can take whatever action they deem necessary to come to a proper conclusion over any serious accident that involves injury to any party.
However they may have to justify their course of action to a magistrate or The CPS, but be under no illusion they are allowed to do this 99.9 % of the time.
Says the Brother in law who is one and investigates accidents regularly.

This ^^^. However I’d add that the depth of ■■■ matters not. Say NOTHING until you have proper representation. Remember, they do this for a living, you don’t!

I don’t really know but I wouldn’t have thought the accident would have to be fatal.

If you was involved in a serious accident and the police had suspicions that either of the things you’ve mentioned could have contributed to the cause of the accident I imagine they could and probably would check either your phone or the vehicle weight or both.

I have been told by many a copper that they can do whatever they like provided they can justify it to both their seniors and the court should it go that far.

Yes.

They will look at situation,i.e fatal then anything/everything is looked at. Don’t think you can hide anything,they are so expert in their examination nothing ,NOTHING is missed. they can even do a computer visualization of the event before and after , and that’s down to their skill and stuff.
If you have done wrong,hold hands up and admit it cos it will go easier on you, if your are not guilty of any offence then they will most prob prove that as well.they are exceptionally good at that type of job.

I did’nt and have never caused an accident, simply asking because of something that happened today.
