POA use advice please

crabsitch:
thank you both i now finally understand the driving hours in a day thing and that the guy who done my cpc was totally wrong when i asked him.

So I can break as and when i want so long as i dont exceed 9hrs driving (10 twice a week) and dont do more than 4.5 driving hours without a 45 min break ?

Yes

Sorry said both and have now seen there were more than two trying to get it through my thick skull !!!

Thank you all you have now made my working day a lot easier !!!

Not sure that I should name the cpc provider but as Clarkson might put it " Some say they are the 4th emergency service!"

Lol, I got an email from them offering me training. I’m assuming at some point I’ve got a car insurance quote or they’ve asked me my profession when doing my breakdown cover and kept details on file.

2hrs Driving
2hrs Ferry (poa)
2.5hrs Driving«««««««« don’t want to confuse matters for you but that would total 6.5 hours duty, which would break the 6 hour rule

No it wouldn’t POA doesn’t count.

It wouldn’t be 6.5hrs duty, POA is not work time, only Driving or Other work is counted as work.

Edit: was beaten to the punch.

I’ve been doing this wrong for years!!! :unamused:
After your reply, got the old book out and I’ll be damned. I need to be thanking you also and now I’m wondering how much time I’ve lost, dread to think

Stupid question here…

Would a typical employer pay you for being on a break??

If you are informed by employer that you cannot take a break whilst on the ferry (in this case) then the tacho either goes on Other Work (eating into actual work time, which employer probably won’t like) or POA (you know how long the ferry crossing will take) which pauses work time but also isn’t rest. But make a note of how much driving time you have used to the point of getting on the ferry as the first 45mins of POA is seen as break and will reset the Tacho drive time to 4.5hrs.

Def this ! I completely forgot about this quirk this week as running about like a proverbial blue A*** Fly and used POA on a couple of long waits and set off drive time reset and I got infringement on for not been on enough driving breaks. Stupid for using POA in first place and even more stupid for forgetting !

It can catch you out .

Should scrap POA forever
