POA or OTHER WORK

Cheers coffeeholic and others so i,m not breaking the law on poa and wtd so all i have to do is keep vosa happy with tacho rules and luck which should be ok as my average driving time with other work is well under 35 hours per week but if i added the ferry time it would be getting near 55 average hours per week

Don’t get too hung up on the ‘freely dispose of your time’ thing. Contray to poular belief it doesn’t apply to breaks, just to rest periods. Breaks and Rests are different beasts and the regulations define them differently.

‘break’ means any period during which a driver may not carry out any driving or any other work and which is used exclusively for recuperation.

Note there is no mention of being able to freely dispose of your time.

‘rest’ means any uninterrupted period during which a driver may freely dispose of his time.

‘daily rest period’ means the daily period during which a driver may freely dispose of his time and covers a ‘regular daily rest period’ and a ‘reduced daily rest period’

‘weekly rest period’ means the weekly period during which a driver may freely dispose of his time and covers a ‘regular weekly rest period’ and a ‘reduced weekly rest period’

So yes, for a rest you must be able to freely dispose of your time but the same thing doesn’t apply for break. It certainly gets a few going when you throw that little point into a discussion on the tacho rules. :wink: :smiley: :smiley:

If you want it to be POA then I would put it down as POA, if not then don’t. Depends if you want to work more than 60 hours a week !?!?!?!
