I started a shift this morning at 6am. But the night trunk was not back with my trailer yet. “Take a seat in the staff room just now” I was told. No problem thinks I. About 0645 they come in. Thats my trailer in,time to get started. Off I go. Drops in Castle Douglas,Dumfries,Annan and Carlisle. I had just finished unloading in Dumfries and was about to head to Annan when It occurred to me I had not taken a break and my 6hrs were up at 12 (It was 1130 at this point) I didn’t want to take 15 there and take a split break with a half hour later on (I don’t believe in them) but it was a bit early to take a full 45 as this would screw my driving times up for later on.
My question is this (finally,I hear you say)
When I did my manual entry in the morning I entered my shift time as break from 0500 saturday morning (time last shift finished) till 0600 this morning. Then I entered POA from 0600 till 0645 (when I got to truck and entered card). Did I need to take a 15 before 12 as I started at 0600 or was I ok to wait till I got to Annan as this would have taken till about 1215 and is a better time for main break and driving times etc? If I waited till Annan I was still within my 6hrs if poa counts as technically not started work.
Hope this made sense. I lost myself a bit trying to type it up!
i dont think poa counts as working time so i would say your ok but bear in mind poa does count to your overall shift time
You started at 6 banged poa in on your man entry that moves the required break on, so your break was needed at 12.45 or before. Poa is NOT counted as work.
But is counted in shift time.

Cool. Cheers guys. That’s what I thought. I plodded on anyway and took it at 1220 as I was pretty sure this was the case.
Was just a bit thoughtful as to whether I got a WTD infringement.
It’s not shift time which triggers a WTD break, it’s be amount of work done and as POA does not count as work for the WTD regulations it isn’t raken into account.
I used to do a night shift of around 9 hours with 4-4.5 hours POA each shift and for months never recorded a single break and it was perfectly legal.
