Poa carried to next week

hi just supposing i start work 6am do 15 hrs working time i have had to wait 2 & a half hours in that 15 hr period poa waiting to tip do these hrs carry on for next week so i can add them on to say 70 hrs which would mean i can work a total of 72 and a half that week or not, as when i start i get paid by the hour but don,t get paid for 45 min break between driving 9 hrs.
also whats the crack about soonest you can start in mourning i was thing of starting on a monday at 6.am the other 4 days while out and about 4.am as i seen something about starting before 4 am in a post somewhere thanx again for all your help your,re a great bunch on a brilliant forum

Not an expert on this but I’ll have a go…
I think the only carry-over rules you have to worry about are Driving hours and any reduced weekly rest periods that will need to be compensated for.

When you say 15 hours working time presumably you mean 15 hours from the start of the shift to the end of the shift, this is the most you could do and still fit a 9 hour minimum daily rest period into the 24 hour period from when the shift began.

You’re only legally allowed to work 60 hours in a single week not 70 but this can be increased by using POA, the working week has to average out at no more than 48 hours working time per week over the reference period (usually 17 weeks)

POA doesn’t count towards the working week for WTD purposes so if you did 70 hours this week and 10 hours of that was recorded on the tachograph chart/card as POA then you would still be legal as only the 60 hours would count for the WTD.

As POA doesn’t count towards the working week carrying it over doesn’t really enter into the regulations.

If you start work between 00:00 and 04:00 you’re considered to be a night worker.
A night worker is only allowed to work for 10 hours during the 24 hour period from the beginning of the shift, this can be increased if the firm you’re working for has a workforce agreement in place.
If you don’t intend to start work before 04:00 the 10 hour rule won’t affect you but it’s worth learning about so you can stay legal.

Night time for mobile workers is:
00:00 to 04:00 for goods vehicles.
01:00 to 04:00 for passenger vehicles.
