Photo licence expired can you still do a dcpc course

I am just checking who is going on a course tomorrow - can one of the lads whos photo card has expired last month still go ? and then send his licence off afterwards or cant he go at all till he gets his new licence back?

With an expired photo card, the driver is effectively banned from driving till its renewed, so I doubt it!!

First thing they did on my course was to check everyone had a valid photocard.

Just to add, the fine is upto £1000 for failure to renew!

Expired photo on a driving licence does not ban a person from driving because the categories are still valid

Expired photo means the ‘licence’ itself is not valid - weird but thats the way the law works

the only charge can be - driving without a valid driving licence

Not certain how dcpc rules work on this issue so I called the DSA dcpc hotline 0191 201 8112 and they stated that if the training provider is happy will all other aspects then simply having an out of date photo is not a legal reason to refuse the training and upload

I tried to double check with the DVLA but they referred me straight back to the DSA dcpc section

The actual validity or just the fact that you’ve got a photocard?

This is a dilemma and I have already queried this with DSA at Director level as their numpties on the helplines couldn’t answer my question.

Some training companies will turn the driver away - in my opinion they are numpties if they do.

The DCPC handbook for trainers tells them they MUST carry out an ID check - not a licence check - an ID check, unless the training involves actual driving. The only allowed documents for the ID check are a photo card driving licence with paper counter part - OR - VALID passport and old style licence or a government issued ID card.

Here’s what it says in the guide:

xxix. Training centres must carry out identity checks in order to verify the identity of
each participant on a course. These checks must be carried out before the course
commences. This requires a visual check of an acceptable form of identification
of either a photo card and counterpart driving licence or a valid passport or valid
identity card (issued under the Identity Cards Act 2006) and ‘old style’ paper driving
licence.
■■■. Training centres must put in place an auditable process to ensure and confirm,
within reason, the identity of the person attending the training course. Failure to
have such a process could lead to removal or suspension of their approved status.
xxxi. Training centres must ensure that any person driving a vehicle as part of a practical
training exercise has an appropriate licence authorising him/her to drive a motor
vehicle of a class included

Notice it does not say the licence that is checked must be VALID. Only the passport or ID card needs to be valid. I had other trainers telling me I was the numpty because I have put drivers through even though the photo card has expired - they would send them away. Sometimes trainers are a little bit ■■■■ and read things into the rules that aren’t there - now where’ve I heard that before■■?

OK - so in answer to your question - I have put drivers through when photocard expired and had no problem. As far as I am concerned I only have to check the ID of the person if they are going to do classroom based training. If they are going to actually drive - I have to check the licence is legal - and an expired photo card is still legal to drive anyway. Whether the licence is valid or not … is that really my problem? I suppose you could argue that if the photo ID has expired - then it isn’t a suitable ID check. BUT … to me, if the photo looks like the guy standing in front of me - it’ll do for me. :smiley:

Anyway - only last week I have had a reply from a Director at DSA to say I have raised some interesting queries and they will come back to me.

I have also asked what they mean by BEFORE the course. If I check someones ID at a course last month, then they turn up today without their licence - surely I checked their ID BEFORE this course when I checked it last month? The DSA helpline said they meant IMMEDIATLY BEFORE the course about to take place - “But that’s not what you wrote in the rules” I replied! :unamused:

Thank you for your email of 26th November.

We can confirm that training should be uploaded even if the photo on the driving licence has expired as long as everything else is up-to-date. However, this is up to the discretion of the individual training school who would need to satisfy themselves that the driver is who they say they are.
