PAYE or LTD.

Are agencies required by law to accept PAYE?
or can they only use self employed drivers?

I realize that behind the scenes they can filter out
PAYE applicants in favour of SE drivers but what if
any are their legal obligations.

I was advised by a large agency to go PAYE as they do all the work, pay your tax & NI.
That said the agency did screw me rotten!
And taxed me at emergency rate instead of my real tax code even with a P45!!

As far as I’m aware agencies have no legal obligation to accept PAYE, I doubt that many agencies would refuse to register a driver on PAYE but most agencies would have him at the bottom of the pecking order when jobs were handed out.

Im on PAYE, also on guaranteed income so quite the opposite they make sure i’m one of the first to get work.

Thanks Tacho I figured that was the case.
The reason I asked was that Im PAYE with an agency already and after
talking with a friend I registered with his agency and they were pushing
me to go LTD,which Im not really interested in.

Since I registered with them they have given various reasons to both
my mate and myself as to why they are crying out for drivers but Im
not getting any shifts. :unamused:

Im not too bothered though as I can go back to my original agency.

Crying out to get drivers on their books as backup probably. So if they do call you, assume they are really in the mire and charge them accordingly…

Agency I keep in contact with initially went totally Sole Trader/ Ltd Co. when Tesco started insisting on them circumventing the new agency regulations a couple of years ago, but they have recently started taking on PAYE again as they think HMRC are going to start sniffing around agencies that have no PAYE on the books and certainly the larger ones don’t seem too worried as to whether you are S/E or PAYE these days.

Gave the agency in question a call this morning,
asked them if I would be likely to be getting a
shift anytime soon.

So if nothing comes in over the weekend then they can stick it
where the sun don’t shine.

At least the Grand Prix and the BTCC are on so no great loss. :laughing:
