Parking up bang on 4.30 drive hours

Do you get an infringement for this? I know I was cutting it a bit fine before anyone lectures me

If it stays on 4:30 after a few minutes, then it’s perfectly legal, technically you must at that point have a 45 min break or 30 if you’ve split it or start a rest period

The law says you can drive 4.30 not 4.29, so why would you get an infringement?

The times there to be used.

I suppose the argument would be by that point it is 4:30 and ■■ seconds

Bloody 'ell, that’s a hanging offence that is …

It counts whole minutes, so there is no concept of being over by X number of seconds.

Driving time is defined as “the duration of driving activity recorded automatically or semi-automatically by the recording equipment” so if the tachograph says you’ve done 4.5 hours driving then you’ve done 4.5 hours driving not 4.5 and some seconds.

As has been said it’s fine to do exactly 4 hours 30 minutes driving before having a break, it’s not advisable but it is legal.

It’s a barsteward when you pull up on exactly 4 hours 30 minutes thinking you’ve just about got away with it then the clock ticks over to 4:31 though :grimacing:

Don’t put ideas in DVSA’s head…another nice little money spinner for them.

If it says 4.30 then thats what iv driven.

No argument needed.

Its whats recorded that counts, not whats been done.

And i mean that in a legal way with no special buttons

I was at 4.35 once. Couldn’t get a safe place to stop .

Done it once or trice, heard nothing of it. Parked up dead on 10 hours drive time too, heard nothing about that either…

Did your tachograph flash up a “driving time exceeded” message on the display? If so it is recorded as an infringement, if not then not.

They’ll all flash up that when it flicks onto 4:30, on a 2nd gen onwards - late 2011, you can carry on driving for upto 29 seconds in that minute, the counter runs in a few seconds delay to the clock, so you’ll probably have at best 25 seconds from when it clicks onto 4:30 and It’ll stay on 4:30. If it stays on 4:30, even with warning going off, it’s not an infringement

As long as it doesn’t tick over to 4.31 you’re fine, I’ve done it twice in the last couple of weeks and the second time it ticked over.

In the Summer we used to one-hit it from Moscow to the Polish border at Brest which was about 16 hours although there weren’t any tachograph rules in place in Russia at the time and eu countries couldn’t take action against driving done there so long as you had had a compliant weekly rest period before re-entering the eu.

That’d be impossible, tacho’s don’t record seconds, they just use seconds to determine how the whole minute is to be recorded

It’s either 4:30 or 4:31, there’s no in between
