If it stays on 4:30 after a few minutes, then itâs perfectly legal, technically you must at that point have a 45 min break or 30 if youâve split it or start a rest period
The law says you can drive 4.30 not 4.29, so why would you get an infringement?

It counts whole minutes, so there is no concept of being over by X number of seconds.

Driving time is defined as âthe duration of driving activity recorded automatically or semi-automatically by the recording equipmentâ so if the tachograph says youâve done 4.5 hours driving then youâve done 4.5 hours driving not 4.5 and some seconds.
As has been said itâs fine to do exactly 4 hours 30 minutes driving before having a break, itâs not advisable but it is legal.
Itâs a barsteward when you pull up on exactly 4 hours 30 minutes thinking youâve just about got away with it then the clock ticks over to 4:31 though

Did your tachograph flash up a âdriving time exceededâ message on the display? If so it is recorded as an infringement, if not then not.

Theyâll all flash up that when it flicks onto 4:30, on a 2nd gen onwards - late 2011, you can carry on driving for upto 29 seconds in that minute, the counter runs in a few seconds delay to the clock, so youâll probably have at best 25 seconds from when it clicks onto 4:30 and Itâll stay on 4:30. If it stays on 4:30, even with warning going off, itâs not an infringement

As long as it doesnât tick over to 4.31 youâre fine, Iâve done it twice in the last couple of weeks and the second time it ticked over.

In the Summer we used to one-hit it from Moscow to the Polish border at Brest which was about 16 hours although there werenât any tachograph rules in place in Russia at the time and eu countries couldnât take action against driving done there so long as you had had a compliant weekly rest period before re-entering the eu.

Think my record was something like 5:30 while over the water.
Duty time I did 27hrs on the card non stop single manned once
I have and never heard anything. Then again vosa might say something like your over by 20secs

Thatâd be impossible, tachoâs donât record seconds, they just use seconds to determine how the whole minute is to be recorded
Itâs either 4:30 or 4:31, thereâs no in between
