Parking notice (private firm)

Evening lads and lasses.
Sister works at the Children’s hospital in birmingham she parks in a pay and display during the day she bought a ticket for the day but due to a hot day said ticket had curled up and the parking bod issued a £60 ticket even tho she had paid.
The private parking company said as she is disputing it its now £100 I’m sure had read on here (have searched but can’t find sorry) they don’t have police or council power to enforce the charge told her not to call or email them as its admitting the cost.

Think I’m right in telling her to ignore but stand to be corrected,sorry mods if in wrong bit on her but thought it would be read more(please move if wrong place) and thanks in advance.

If its a parking charge notice it is not enforceable except by taking her to court for non payment, most private companies don’t bother and after chasing the bill for a few months give up.

If its penalty notice and she has a valid ticket, then simply appeal the fine sending a copy of the paid for ticket, it should be rescinded- keep the original just in case you need to produce it at a later date

The advice to ignore has now been changed. Get on to the Pepipoo forum and you will find all helpful knowledgable posters and even template appeal letters. Post up her ticket and they may even find a discrepancy or another reason to have the ticket invalidated.

Yes. Ignore it. It is just an invitation to pay it and bin the threatening letters that use scare tactics and jargon in the hope you pay it.

Tell her to contact the hospital PALS. Get them to cancel on her behalf. As said for best advice go to pepipoo.

Never ignore these - although they are not enforceable, there are some that will try via the courts, especially if you don’t reply - they will think you are an easy win - if you don’t respond to a Court action or appear in court, they win by default.

Best thing to do is wait for the Notice to Keeper (NTK) to arrive; assuming the Parking Charge Notice (PCN) was left on the car, they have to contact the DVLA to get Registered Keeper’s details - this costs them money (£2.60 last I heard). Then you appeal the NTK, which they will most likely decline anyway - in which case they have to offer you another appeal to their Appeals Service (either BPA or IPC/IAS) - again this will cost them money (approx £27) - so make them spend out to get nothing.

The appeal is simple, a valid ticket was purchased - send a copy of the ticket (not the original). Never phone these cowboys, or email them, always deal in writing.

If they decline both appeals, then let them run with it - they will send various threats of Courts, CCJs, bad credit, Bankruptcy etc - ignore these. The only thing not to ignore is Court Action letter (normally from Northampton Bulk processing centre).

Also, complain to the Hospital and demand they have the charge cancelled.

Spoke to my sister this morning she took the appeal to POPLA who rejected it even tho she sent a copy of a valid parking ticket.
It’s now £100 so she’s waiting for a letter from the parking company and take it from there,they said its because the parking bod couldn’t read the ticket in the windscreen.

Yeap, POPLA will reject most appeals as they are funded by the Cowboys parking firms who pay a fee to the a member of their club - but claim to be unbiased…!!!

Your sister will now receive various demands from the Parking Co, threats of CCJ’s etc, bad credit, first born child in to slavery etc etc, then letters from their pet Debt Collector - probably either Debt Recovery Plus (DRP) or Gladstones - who will tell you that the debt has increased to £160. Ignore them, don’t bother getting into debate with them - if you want just send them one letter denying any debt, state they are harassing you and if they believe they have a case to answer then go to court, and you will counterclaim for harassment & compensation for wasting your time. At some point you will get an offer of a reduced payment in an attempt to settle before court.

The only thing to not ignore is an official Court document - but be alert to them sending you a fake one to scare you, usually these say “an example is attached”. There will be an an official stamp on a genuine one, and a number you can ring to verify - usually Northampton Bulk Processing - but court action is highly unlikely and a long way off.

The one case that seriously threatened court had gone on for over a year so I advised them that I would counterclaim for:

Per letter received from them or their agents / collectors dating back to (and including) the original PCN - £200.00 as harassment & stress compensation and to cover my time to read, research & divulge.

Per letter I sent back to the parking co, their agent or debt collector, dating back to (and including) my original appeal letter - £150.00 - to cover my time & reasonable costs - electricity, postage, paper, envelope etc

To attend court - £250 per day for loss of earnings, plus mileage 50p per mile and parking at £5.00 per hour, plus Hotel at £200.00 per night (Room & Food) if court distance was over 2 hours drive from my house.

Legal Fees (for my solicitor to advise & attend) - whatever Solicitor’s Fees I incurred plus 10%

Witness Fee - £200 per day for loss of earnings, plus mileage 50p per mile and parking at £5.00 per hour (the witness in my case was the person who agreed I could park in their car park), plus Hotel at £200.00 per night (Room & Food) if court distance was over 2 hours drive from their house.

As I’m self-employed - all plus VAT as well…!!

Every letter they sent me, I sent one back - and ended it stating there was charge of £150 for writing the letter, and a charge of £200 if they responded and that these charges would be claimed in Court if they choose to continue down that route - so if it went to court, I had evidence that they knew full well I would claim.

They backed down in the end, as the spreadsheet was pushing £10,000.00 + solicitors fees + VAT

I get PCNs regularly ,I ignore them because I live in Scotland where the law is different.Your sister need not worry,after she gets pepipoo advice she could send a P.O for £1.50 to cover the companys out of pocket expenses. If it goes to court she can say that she has not not paid but been reasonable and paid.Dont send a cheque because they dont need her banking details.

Photocopy of the ticket as proof and it will be fine.
I had the same thing happen in a council carpark. Supplied the proof of purchase in the appeal and they sacked the fine off.
