Mate of mine in Kent had his car damaged at some yard, trailer had caught the rear O/S wing and nearly ripped it off! (Not funny, was a BMW M3! But i did giggle!) However, when he went to claim of Companies insurance, they came back saying he shouldn’t have parked in a veh manoeuvring yard. As it wasn’t a marked ■■■■■■■■■■■■ and inside a known hazardous area they wouldn’t cover the claim. How many times have i turned up at some yard to find cars parked inside the yard, some at precarious areas where it is obvious that it will be a tight squeeze entering and exiting the yard! Even at some of the places I’ve worked from, bosses car is usually right next to the door, and usually some top end BMW/Merc, wonder if they fully realise that they may not be covered for parking in a manoeuvring area for HGV’s?
a few weeks ago,i caught a car’s bonnet with my trailer in a designated lorry manouvering area at a customers premises.although the staff are told not to park there,they do anyway.when i told the insurance people this,they said they know that,but the fact is i shouldn’t have hit a parked vehicle.the woman owner got a courtesy car while her car was being repaired,and i had to go on a driver assesment
now when i go to that store,i have to drive into a busy car park,and reverse into their premises,putting pedestrians and car drivers,who seem oblivious to the fact a large vehicle is trying to manouver, at risk.
The problem is that it would appear to be a hit and run, no doubt your mate would be able to claim against the driver who hit his car if identified.
Claiming against an owner of land when a third party has caused damage is fraught with problems wherever it is.
No CCTV i suppose to indentify the non driver?

This. If you could get the driver who hit the car’s details, then they’re liable for the damage. Even if you hit a 100% illegally parked vehicle, you’re still liable because you shouldn’t hit a none-moving item and would have no defence against it.

When you go there ask for a banksman to assist you reversing, if they refuse then inform your employer.

Makes no odds if there’s signs or not fella. By allowing vehicles to park on your premises you accept liability those signs are a waste of time

A disclaimer sign cannot take away statutory rights.
A Tesco car park would be regarded as a public highway so accidents on it would be deemed to come under the Road Traffic Act.
Just spoke to him last night, apparently the two opposing insurance companies are dealing with it amongst themselves, His company is saying that the yard comes under yard owners insurance regardless, the yards company are saying he shouldn’t have parked in what is obviously a manoeuvring area to get in and out of the bays. He’s going to try and get some pics, will post on here see what everyone reckons!
Although i can see both sides point of view, i have also been in some places where it is nigh on impossible to reverse into the bay due to a multitude of employees vehicles littered all over the place despite there being designated parking 100yrds down the road. Or maybe thats the problem…100 yards down the road!
So he only has third party insurance then
