Parking at operating center?

Wonder if anyone could help!!!
I have parked my 7.5 ton lorry at the workshop were I work as a mechanic for the past 4 years, sorry forgot to mention I only use the lorry to carry my race car it is taxed Private heavy goods.the yard is used as a operatin centre for 6 vehicles .The new boss has just told me that this is breaking the terms of the o lience is he right? .Or is he just trying to put his mark on the job? I will have to move it but just wanted to if he is right or just being a TW#T!!!

He could be quite correct, it depends how many vehicles are authorised and if the yard is of sufficient size, if the licence is due for renewal, he may be just covering his arse.

Operating Centre
The operating centre is defined as the location where the vehicle is normally kept. Full details of each operating centre, including number of vehicles and trailers to be authorised plus “off street” parking available, must be given.

The Traffic Commissioner can refuse the use of an operating centre on road safety, parking and environmental grounds.

Anyone have any thoughts on this■■?

i wouldn’t of thought having your private vehicle parked there would have anything to do with his operating licence, if it is the case then what about if you drove a car to work thats a private vehicle. just because you have a 7.5 tonner means nothing to his licence. the vehicle is not used by him or reg’d to him its not a vehicle used by you or anyone else for hire and reward

if he only has space for 6 authorized trucks and your using 1 space for your own, causing 1 of his to park elsewhere then he is probably right.

A company where I worked had a routine fleet check and they pulled a company ■■■■■■ van over the pit to check it over :exclamation:

He may be curtailed by Planning Permission for the number of trucks he can park at the site, which may be a factor in his comments, otherwise as your truck is out of scope for “O License” purposes he shouldn`t have a problem.

Do you pay to park the truck there and if not is he maybe suggesting you should ■■? :confused:

Have a look in applications and decisions to see what is or isn’t allowed :stuck_out_tongue:

Personally, as long as there is still sufficient space to park the number of vehicles authorised on his o-licence, I don’t think parking a private vehicle of any size on the site makes any difference whatsoever to his licence.

5.3 The owners or occupiers of land, or buildings, in the vicinity of an operating centre, who feel that the use of a site as an operating centre will prejudicially affect their use or enjoyment of their land, have the right to make representations to the Traffic Commissioner about an application for a new licence or a variation. Representations may be made only on environmental grounds and it is up to the Traffic Commissioner to decide, in the light of local circumstances, the geographical limit of “the vicinity” of an operating centre.

Took a truck for test today and got talking to the tester re:parking my truck.
He called the station manager across and explained the situation ,
He informed me that the T/C has only got a say on vehicles that are listed on the O Liecence not PHGV like mine.So I guess the new boss is getting no help from me [zb]!!! :imp:
