Panicking Trucker Question

Somehow i have lost my last 28 days worth of tacho’s (not many, as i normally only do 2 days a week at most on the agency around my other job). i have no idea how i have lost them, i normally keep them in my “trucking” folder but tonight i have been sorting my stuff out for IF i get any work over the weekend and noticed they were missing. i have a feeling they may be in my drawer at work but I’m not very positive about this at all. :imp: :imp:

where do i stand legally?

i know it isn’t too big a problem as most work i do is on a digital so all that data is stored on the card, the main problem is i had 3 analogue tacho’s, i know the hours i worked on them but cant remember what hours i was driving and other work, rest or the reg of the vehicles or mileage.

what would happen if i filled in some more analogues but without the vehicle details and got a tug at the roadside?

before anyone is holier than thou and says i shouldn’t have lost them and been more careful blah blah blah… do you not think i know that?

What can I do if I have lost or ruined a chart, or had my chart(s) stolen?
A note should be produced for your employer’s files explaining the circumstances for the loss/damage of the charts in question. It may also help your case if you can produce some paperwork proving, for instance, that the theft of the charts had been reported to the police. Depending on the circumstances involved you may also wish to contact your local area office of the Vehicle and Operator Services Agency (See Annex E of GV262 and Annex D of PSV375 for contact details) about the loss/damage of the chart(s).

I quite often lost mine…at least you cant get nicked for tacho infringements…cos without the evidence…there is no infringement…!!

However you can get prosecuted for failing to keep/produce records, but thats better than the other option…
