Judge: Walmart Must Pay Truckers For All Time Worked - TruckersReport.com…but are they accepting liability for responsibility for the wagon and cargo?
That’s an interesting point. Even though the driver is on break, they are still responsible for the vehicle and cargo. Therefore they should be on pay. I wonder what would happen if that was put to the test in the U.K?
From what I remember, ship’s crews get paid for the full time they’re aboard (feel free to correct or confirm that comment). If thats so, it’s not like there isn’t a precedent.
Whether we’re responsible for our kit on nights out or not, how many would realistically get out and investigate at 2am if you heard someone tampering with your fuel tank for example?
Lose a couple hundred litres of company diesel, or go out n face a probable kicking? I suppose it’s a little different if you’re an OD, but the risks are still the same. Although you can always factor parking costs into your rates, whereas an employed driver may not get parking paid, as I don’t (unless high value load).
For £63,000 pa - I’d be quite happy to be in charge of my truck 24/7 and be held liable for any damage/theft from it.
For laying that risk myself - I’d benefit from the far higher pay (around double the best full time rates as it stands) in exchange for “Being careful where I park at night” to minimize the theft risk, and “driving as I do now” ie. accident-free and safe - meaning I double my pay for pretty much no effort extra at all to the way I handle a truck now!
