I would say rest - he is not doing work, if you choose to pay him it’s none of VOSA’s business.
The hours worked are all that matters, you can pay for 24hrs a day if you want, as long as the legal minimum rest is taken then work can commence

once he has left work and he can freely dispose of his time he is on daily rest, other wise how would someone on salary say who finished early one day for what ever reason know when they could start again. you have sent him home end of story

I did just that today,started 1 a.m and finished 8 a.m,was told I could get off and they logged me off on iso-trac at 11.30( we have to do/ have 10.5 hrs showing on system to get paid our 50 guaranteed hours) ,when I put my manual entry in the morning I will put it in as p.o.a. My start time for tomorrow is 1 a.m but if if they wanted me to start earlier ,the earliest would be 20.30 pm tonight.
My own thoughts are my run sheet shows me finishing at 11.30 a.m,my defect sheet has a finishing time of 11.30 a.m,I’m logged off the iso-trac at 11.30 a.m,my time book shows 11.30 a.m so as far as I’m concerned I can’t start until 20.30 p.m,
N.b company have no issues with this,that’s how they want it doing
As soon as you send him home, he’s finished work. Paid hours is irrelevant, especially as it won’t show on his tacho or anything.

As others have said the paid hours are irrelevant, if he’s free to dispose of his time freely he’s on rest.
He could start work again 9/11 hours after finishing work for you as long as that’s the time he books off on the tachograph card/chart, the 2 extra paid hours don’t count as work.
