    Can an employee be forced to work overtime?
    Employees only have to work overtime if their contract says so.

Even if it does, by law, they can’t usually be forced to work more than an average of 48 hours per week. An employee can agree to work longer - but this agreement must be in writing and signed by them.

Can an employee be stopped from working overtime?
Unless an employee’s contract guarantees them overtime, their employer can stop them from working it.

However, their employer can’t discriminate against anyone, eg by stopping some employees from working overtime while letting others do so.

48 hrs has never been the maximum, just the maximum average over your agreed reference period. 60 hrs has always been the maximum, and like you stated, driving + other work = working time. Breaks and poa can take you over the 60 hrs, which is the whole reason I’ve said from day one that the wtd is horse ■■■■

Wots the difference between a contract of 55 hours per week, and being told you have a 40 hour week with 15 hours contract overtime?

It’s probably better to have the salaried version, as if you go home early on the overtimed version - you might get done for “overtime fraud”… :bulb:

The WTD has successfully been got around by employers everywhere, as has the DCPC.
What WTD SHOULD have done - is limit people’s TOTAL working hours to 48 average, rather than 80 hours with 32 hours bloody POA.
What DCPC SHOULD have done - is prevent those with too-low a standard of spoken English - getting any jobs over here, and thus depriving the rest of us of that same job. “Too easy to pass” also creates a glut of “blue-cared drivers” thus keeping wages down. The wheeze of getting agency drivers to pay for their own blue cards - turns a tidy profit for the authorities letting all these red-taped bullcrap rules through in the first place as well.

I thought it was 84 hours maximum. 3 x 15hrs, and 3 x 13hrs.

60 hrs is max working time. 84 is your legal maximum on the tacho, but 24 need to be break or poa

With split daily rests you can 6x15s for a total of 90 hours.

That’s 2 weeks work even for child slaves in China.
