hi lads the other day i went to pick a load up with my 26 tonne rigid scania. the notes i had from my office said 14,800 tonne they load me with class 3 adr load and said they will have to put two on top i said don t fancy that but went ahead and strapped them tight. then i got paperwork off them. it said 15,800. i said u not got a weighbridge they said no but thats right i said it can only take 16 tonne max he said it 15,800 i gotvto delivery point birmingham they had weighbride i said i want weighing on and off my net weight was 17.100 well well over i told the office its ridiculous so i have nt been to office yet as still away i want to know what implications could have happened to me as i did not know it was overweight until i got to the weighbridge at delivery i want to know my rights before i confront compliance manager i think at end of day it was collection fault their weights wrong i thought could be over but how do i know without weighbridge so had to go off paperwork theirs 15,800 thanx in advance lads

if you do not do this, and you get stopped and consequently found to be overweight (load, not you personally), then you can be prosecuted, regardless if the paperwork says you are underweight

A driver may go directly to a weighbridge and return to the point of loading without penalty if overloaded
The only exception would be if the vehicle etc was deemed to be unsafe
If you suspect your overweight you should go to your nearest public weighbridge. If your delivery is the closest weighbridge then hey . It would be harsh for your company to punish you because you took it on faith that the ticket was right and you weren’t able to weigh it until it was tipped. It would have also caused them more hassle if you had gone to a public weighbridge because they would have had have sorted it out.

It isn’t their fault the paperwork is wrong. It IS YOUR FAULT for doing the journey overweight.
Golden rule of HGV Driving: THE DRIVER IS RESPONSIBLE FOR EVERYTHING.
As has been said, you are only covered driving to the nearest public weighbridge. The fact that may be 5 miles in the opposite direction to where you’re going is irrelevant and saying that the only one on route is at the delivery point is likely to see you with a fine.

Yeah I can see that in practice, queue for hours to find out that your load of polystyrene is well underweight.
Then pay for the weighbridge out of your own pocket!

The goods may well have been 15800kgs, but that weight may not included the weight of the pallets they are sat on!

The important word to bear in mind is nearest. You can’t use that as a defence if you’ve driven past a few weighbridges on the way.
Likewise you have to be on your way to the nearest practical place to correct the overload. This can be open to interpretation and rather depends on what the load is.
