Out of scope work

Just curious,but if a driver was given a bus to do some work in and that vehicle has a digi tacho fitted,the vehicle is been used on non eu work and the driver does not have a digi card,should/could it be put to ‘out of scope’ on the digitacho,regardless wether there is a digicard inserted or not? and is it possible to put it ‘out of scope’ without a card in?

i would guess at no as if it has a digi tach u must have a card to drive it but i will stand corrected if i’m wrong

According to (Page 26)Rules on Drivers’ Hours and Tachographs (Passenger-carrying vehicles in the UK and Europe), you don’t need to use the tachograph if you’re out of scope of the EU regulations.

I think you can put the vehicle out of scope without a card inserted, but perhaps someone who currently uses a digital tachograph will be able to enlighten us more, I haven’t used one for a while.

scaniaman2006, it’s true that you can only drive a vehicle fitted with a digital tachograph in-scope of EU regulations if you have the card, but in this case it’s being driven out of scope of the EU regulations, apparently.

If you use a vehicle that is exempt from the EU drivers hours rules you do not have to use the tacho, if one is fitted to the vehicle. For HGVs the record keeping requirement under Domestic Hours is; a log book or using a tacho that is fitted to the vehicle. There are exemptions from keeping Domestic Hours records. For PSV’s there are no record keeping requirements when used under Domestic Hours.

Where you have to be careful is that if you drive EU in a week you need to keep records of other work (which include driving vehicle subject to Domestic Hours) for that week. It may be easier to put your driver card in the tacho and set the tacho to record ‘out of scope.’

You can set a tacho to ‘out of scope’ with or without a driver card in it. If you then insert a card or eject a card that was inserted when ‘out of scope’ was selected, the ‘out of scope’ will be automatically cancelled.
