Out of hours before base?

Hi All

I’m pretty sure I’ve read somewhere that if you run out of hours by about 15 minutes or so from base, you are allowed to continue to stop you from having to do a full night out. I’m almost certain I’ve read this somewhere, can someone confirm?

Maybe once or twice but certainly not on a regular basis or every darts night.

You should sign & annotate a printout if you have a valid reason for being out of time, such as a road closure, accident or for load security.

No I’m pretty sure I’ve seen it actually in a handbook or something like that, I could be wrong though but I’m almost sure i’ve seen it printed somewhere.

There is a sort of get you home clause but only if you are on British Domestic rules, but it only covers driving time not duty time. It would prevent a refuse cart driver having to have a night out in the back of his S&D

Yep there is a comment on the Vosa drivers hrs page allowing this in those circumstances…but do not abuse it and its a 15 min MAX.

No I am not seeing it, what I am seeing is wording such as :

If ■■■ time exceeded by X minutes

  • and in isolated cases

I think if you are already planning on exceeding it, you will soon find out the meaning of Isolated.

The lad has just got a new job less than a week ago and he is looking for loopholes in the law already. The planning must be tight, if this is the case, yet another company to be invited in front of Mrs Aitken.

For anyone else, don’t try this away from your own country in Europe. :stuck_out_tongue:

And just a little bit lower down it say’s unless a reasonable justification is given,ie finish of duty and is very close to base…Although yes,I agree with you,it certainly doesn’t give carte blanche to take the mick.

And next to that is the sanction they may take. TE160DH

TE160DH means prohibition for overweight or drivers hours offences

Companies must notify the Traffic Commissioner
of all prohibitions as soon as possible, but in any
event within 28 days.

I can’t see that you’ll get away with it regularly.

But once in a while (less than monthly) I think VOSA will leave you alone.

On a positive note if you’re new you’ll get quicker naturally (doors and curtains and the like not the driving) so you’ll usually get home on what seems to be very tight planning.

Be careful and don’t take the ■■■■ because if enough drivers do they’ll tighten the rules and you’ll ■■■■ us all

sam , it might well be written somewhere for extreme cases but I think you should ignore it and remember as rog said earlier “insufficient daily rest”, it is not a good thing to be seeing on a drivers hour record at any time as it gives vosa the impression your not really to bothered about drivers hours if it shows up every now and again and inevitably will end up costing you a fine or worse

Interesting document though you might want to consider that it’s a “Policy” document which means it’s a guideline or best practice document…not a “get out of jail free” card.

If the warrent card holding officer thinks your taking the mick and you’ve got pending multiple violations or repeated offences then he’s likely to bounce the book off of your forehead and issue Fixed Penalties till the cows come home. Afterall everything we pay goes towards next years Christmas bonus and that’s a little over 350 days away and things are getting more expensive… :smiley:
