Operators Licence

Is a company who’s went bankrupt, aloud to still hold a Operators licence?

The Traffic Commissioner MUST revoke a standard licence if the holder no longer fulfills the requirements of good repute, financial standing or professional competence

He may revoke suspend or limit any type of licence if the licence holder had been made bankrupt or has gone into liquidation.

So strictly speaking yes an operator can still hold an O licence is hes been made bankrupt…although there may be certain limits placed on that licence.

In short no. If the operator has gone bankrupt then they can not fulfil their financial standing and as a result the licence would be revoked or suspended. If they had any sense then they would surrender the licence just before bankruptcy starts, this makes it far easier to get a new licence in the future as you can answer truthfully “no” to the question about having ever had a licence suspended or revoked in the past.

Thats incorrect. Read Goods Vehicle Operator Licensing which is where I made the original quote from! ‘He MAY revoke suspend or limit any type of licence if the licence holder had been made bankrupt or has gone into liquidation’

I agree this may be confusing as it also states you must have a good financial standing!!!■■
