Seeking some advice here as I have never applied for one before.
It may sound strange but for various reasons I want to apply for an O license under my wifes name and set the company up in her name. Now she doesn’t know anything about transport rules and regs while I do, will the TC just grant it or will they want to speak to her to see who will be keeping on top of things? I am not a qualified Transport Manager so will sub out the CPC transport managers role.
Will that cause any problems?

Shouldn’t do, they just don’t want anyone dodgy. Only way you’ll find out is if you apply, they can only say, you need to do this, this & this before we grant it.
Why don’t you employ a Transport Manager and get his / her advice on forming the company correctly.
The TM would then apply for the O licence in the company’s name, once you have everything set up properly in order to be compliant.
This is what I have done when I have been TM.
A good TM won’t be cheap, but will take all the hassle out of obtaining - and hanging on to the O licence.

Theoretically it won’t be a problem unless the TC suspects that your wife is a “front” for somebody else’s operation, and to be honest, your post does sort of imply that she might be.
Plenty of women running haulage companies so wouldn’t raise any eyebrows.
Depending on the reasons if you can’t obtain one yourself there’s a good chance it may be revoked in the future and then that’s the wife’s repute gone too so it is best to be as transparent as possible.

Have a read through … as long as your wife is of good repute and has the finance available shouldn’t be a problem
but I agree that you should employ a TM as you will need one to fill out a TM1 for the company
and its better if filled out and submitted all together .
