when you get pulled by the UKBA. say [zb] all.
and when i say [zb] all, i mean absolutily nothing, not even hello.
stop. hand over your passport, and driving licence. then don’t answer anything whatsoever.
Why?
because if someone has put something in your load, or on your truck. and you know nothing about it. they will still want to prosecute someone. they don’t care about justice at all. as long as they can arrest, and charge someone, they are happy.
the trouble is, it is the driver who is arrested in every occasion.
but the thing is, they can’t arrest you, or charge you until they can confirm what language you speak. and having a UK passport in this day and age, dosn’t mean you speak english.

No one can arrest anybody without meeting one of the 6 arrest necessities under sec 24 of PACE

The reasons are– .
(a)to enable the name of the person in question to be ascertained (in the case where the constable does not know, and cannot readily ascertain, the person’s name, or has reasonable grounds for doubting whether a name given by the person as his name is his real name); .
(b)correspondingly as regards the person’s address; .
(c)to prevent the person in question– .
(i)causing physical injury to himself or any other person; .
(ii)suffering physical injury; .
(iii)causing loss of or damage to property; .
(iv)committing an offence against public decency (subject to subsection (6)); or .
(v)causing an unlawful obstruction of the highway; .
(d)to protect a child or other vulnerable person from the person in question; .
(e)to allow the prompt and effective investigation of the offence or of the conduct of the person in question; .
(f)to prevent any prosecution for the offence from being hindered by the disappearance of the person in question.

So (a) is the 1 that they can arrest you on then. (e) and (f) will suffice also.

it took some time for me to figure out why 2 romanians that i knew, were never searched.
they would chat in english on the ferry, but never spoke a word to the UKBA.
so the UKBA just gave them back the CMR’s, and passports.
everyone must be read their rights, and if they did have a romanian interpreter, then they make out that they don’t speak romanian. :laughing:
to much hassle to abide by the rules.
simple really.

no. you are missing the point.
none of us really know what is in the trailer, but we are the ones who get arrested, no matter what.
so, say [zb] all, and the chances are you will be on your way. so you can carry on with your job.

Theres an abundance of reasons they could arrest you for whether you speak or not and whether you have something in your trailer or not. When someone is arrested either by police or customs it will always be ‘on suspicion of’. Just because you are arrested doesnt mean your guilty its just the starting point of an investigation. I could go on and on but your tip is so rubbish its not even worth going on anymore!

You only think you know what is in your trailer. Unless you personally pack the boxes/tins whatever and palletise it yourself, you can never be truly sure what is in the load. Many an honest driver has been caught by foreign authorities for having illegal substances hidden in the load without there knowledge.

Not a lot of point putting a seal on 10 minutes away from the port. The only way is to seal the trailer at the point of loading and record it on the CMR and get the customer to sign your check sheet too.

Your check 10 minutes away should be only to check there are not cuts, there is no one sat on the axle, the seal is still intact and the cord isn’t broken.

The other bit of advice is when they do question you, and you have broken the veil of silence, get legal advice.

I was stuffed up a few years back having been taken in for a ‘friendly chat’ which turned out very very bad as it was insisted I did not need legal or union advice for this ‘friendly chat’.

But I can understand your point of view Phil. There are a few security places that I have been to where the guards don’t want to speak back to you even, just want your ID card and proof of access. The rest is a waste of time. If anything curt responses are preferred.

Not at all because then people can still get into your trailer when parked overnight. From the government that is what they recomend to do a check. As long as all paperwork is in check and no packaging broken on pallets then you shouldnt have a problem IF anything is found. I know i haven’t.

One driver for a firm up this way did all the checks etc as laid down but immegrants still manahed to get in but aas he could prove he did it how they told him he got a £50 fine he told me. If true i dont know but company i worked for insisted it was done that way

i have not mentioned anyone deliberatly commiting a crime, i’m not trying to say that by not speaking english, you somehow get away with something.
once again, i will try to explain:
several trucks get pulled. there are the flip flops who say “no english, no english, no comprende”. UKBA staff can’t be bothered with them, and wave them on. the reason for this, is because they must be sure that the driver can understand them before being questioned in any way. and being questioned does not mean you have commited a crime, or that you are suspected of commiting a crime.
then there are the english speaking drivers. the UKBA know they speak english, and hold them up.

so if you make out that you can’t understand them, then they seem to wave you on. simple.

Good pint Phil,in Europe they do not care what the lingo is,they say i must pay fine,but when watching those cop tv shows in the uk,when they stop a foreigner,they ring up a translator to book the offender.

well what can I say except that IN ITALY they had folders of answers in more than one language and so i was able to understand why they done me , The Germans have the same when they wish to use it, and well the Dutch, belgian Austrian can converse in english when they wish to unfortunately that is lacking in the UK although it has improved some what ,
