i was comin out of a road up near the perth post office this afternoon, 40ft 15ft6 i was turnin right heading for a roundabout, looking left/right/left again signal manouvre BANG!! a mini had blooterd round a bend & wedged between me & a parked up punto :open_mouth: i reversed got out asked him was he allright,yeah fine,we’ll just exchange details… don’t fink so,you must have been traveling matey no slide screech of brakes NADA!! I phoned for plod, the driver of the mini his mate shows up, plod shows up,AMBULANCE shows up, & matey from the mini whisked away with a neck brace in a WHEELCHAIR in the AMBULANCE,i’m blowin in the bag ZERO it comes up, the law said no charges for anybody 50/50 i feel robbed,. :imp:

must be somethingthey put in the irn-bru up there…a woman(blonde) drove into the side of me just outside of perth last year… :angry:
i started taking details,and handily,a few fotogs.she (blonde)in the meantime is phoning the filth and the fire brigade cos,acording to her, my tanker is ā€œon fireā€¦ā€ within 5 mins its the biggest event all week/month… :open_mouth:
turns out the ā€œfireā€ was steam coming out the top of ther barrel after a decent hot soapy wash and steam up @ tankwash…how we all laughed :slight_smile: :slight_smile: except blondie who a bollocking from the boys in wellies and yellow hats!

Don’t admit anything. The kid was too fast . Did you have a witness? The police have no power to decide there and then who is responsible. The matter needs taken further.

i’ve spoken with the works insurance, & the girl believes that they’re in for a hefty hit due to the mini ā– ā– ā– ā–  !! & she informed me i’m @ fault because i was the 1 joining the road. :confused:

What was the speed limit? Who came real traffic police or nomal bobbies?

It sounds like the other driver was at fault. Stop in the distance you can see to be clear and all that. I mean surely you can’t miss a 50 ft lorry pulling out of a junction in the daylight :question:

mini drivers grrrrrrrr i hate them, lets hope somebody saw whatr happened and the mini driver gets it hard cause who can miss a 15ft high lorry

my missus had a similar thing a few years back, she went to pull off at a roundabout but stalled with the nose of the car about 3 ft into the roundabout and a woman speeding hit the side of her, due to no one being hurt the police werent called and they wouldnt do speed tests for it so she had to take it on the chin, if you get 50/50 outta it then ithink you will get off lightly.
was it a proper mini or a wannabe?? if the latter then thats one less in the world

By stalling though she left herself obstructing the junction due to not being in control of the vehicle, so I would agree that should be at least 50/50 fault.

In a past life I used to settle insurance claims. Most insurers had agreements not to dispute losses with each other because disputes are expensive. The cheaper ones have eroded this cosy arrangement and will often fight for every penny. You should see some of the demands they make — aimed at intimidating the 3rd party.

The problem remains though that very few accidents are 100% down to one driver. There is nearly always some fault on both sides and, of course, both drivers will blame each other. I have seen statements that, if you believed them, say that, at the time of the collision, both cars were stationary and sounding their horns.

In the absence of witnesses it is next to impossible to know who is lying so the insurers will just settle; sometimes each pay 50% and sometimes each party pays their own costs. Only very large claims will ever go to court. Uninsured losses are another matter entirely and if you are an innocent victim you will want to recover your excess at least — this is where full comp cover is worthwhile.

Most fleet owners keep insurance costs down by having a huge excess. Up to Ā£million in some large firms. They will have a department devoted to recovering every cost they can and they are very good at it. As always it’s the small firms and the owner drivers who get screwed.

Always take pics of the damage to stop the 3rd party inflating their claim.
Always try to get witnesses if you can
Never admit liability unless you are at fault and want to try to settle without the insurers being involved. (Always a good idea if the damage is slight).
When you describe the accident don’t waffle — keep it simple and to the point. There is a rule of thumb that says that more waffle equals less truth.
