Non tacho driving

Can someone point me something legal or what is legal.
Basically at work we’ve all been told some days we could be using a van. Obviously you still have to follow all tacho rules.
So what’s the score.

So what’s the score do we just do a manual entry next time we use a truck?
Or would an assertion form. /Book be enough just carry that around.
Or do we need to legally do manual entries . Just curious as management arnt really giving us any answers and I know some drivers wouldn’t know how to do a manual entry

Everything you need is here. You must record all activities as you’re bound by mobile worker rules, and the EU drivers hours legislation.

A written record with a subsequent manual entry when next in lorry would be satisfactory.

So basically you need do manual entries using notes from.book you can’t just leave days blank when been in a van

If you do any In Scope of Assimilated and AETR rules (what was EU rules) driving in a week you must obey EU rules all week long, correct.
You have the choice to put hrs worked, when a tacho is not available, as a manual entry or as a written record on the back of a tacho roll.

I would suggest that using a tacho roll is easier to get correct rather than doing a few days worth of working/ breaks/rests etc flawlessly as a Manual Entry.

(Driving in a non-lgv is of course just duty, not driving)

You will not be under GB Domestic rules if you are driving under EU rules during a week.

Open to correction.

There’s nothing specific in the legislation regarding manual entry records for vehicles not fitted with a tachograph.

But as you’re still bound by lorry rules, you need to have a legitimate record of your activities. Which as correctly stated can consist of using a printout (remembering to fill the details in fully and accurately).

It would be good practice to fill in a log book, showing a daily walk around check and more importantly your start times and break times, just to save argument at any check you may be pulled into.

From Drivers’ hours and tachographs: goods vehicles - 4. Tachograph rules - Guidance - GOV.UK
"When a tachograph is not available to record data in real time, the only permitted methods for drivers to make a manual entry are to:

  • make a manual entry on an analogue tachograph record sheet
  • make a manual entry on digital printout paper
  • retrospectively use the manual input facility on a digital tachograph when the card is next inserted"

Log books etc used to be an acceptable method to keep records but are not now permitted.

Don’t worry about it get pulled keep schtum
