The driver also stated he was suffering from ill health and needed his licence to visit hospital for appointments

a Value sentence?

Prosecutor Rebecca Ritson said Kelly had been recorded at speeds between 48-56mph on August 17, 18 and 31 and again on September 2. The limit for his Volvo HGV was 40mph.

Kelly, representing himself, told the court: “I have been driving for 46 years. I have always taken great pride in having a clean licence and I would like to think I am one of the most considerate drivers on the road.

One of the most considerate drivers on the road? Consistent speeds of 48-56mph on a 40mph road and gets away with it. Cheap fines too. Complete joke. The Magistrates Courts are so inconsistent.

“His licence was endorsed with three penalty points for each of the four speeding offences.”

That’s 12 points, has to be an automatic ban surely?

He could still loose his LGV licence if the Traffic Commissioners so decide.

No, there are exceptions to this. I worked with a lad who had 27 points on his licence (all speeding), and still had it. However, any speeding fine got £1000 per 1mph if I remember correctly, so he got done (when going from 24 to 27 points) 7 thousand quid fine for 37 in a 30. I think I’d have rather been banned.
He used to say that it was impossible not to get speeding tickets driving for a living - he was a taxi driver, as was I at the time - but I’ve had a clean licence now for a while, only ever had 1 speeding ticket (that stuck) and that was for being absolutely stupid on a motorbike which got me 6 points and 350 quid fine + costs.

it’s not always automatic. A driver at our place was on 12 for a couple of months but he didn’t get banned. My wife was also on 12 for a while but no ban after her work wrote to the court saying the licence was vital in her work caring for the elderly.

he played the system, and kept his licence.
good man.

Surly if his ill health caused him to speed it should be stopping him from driving

Seems very odd that he got let off being banned and only got a tiny fine

but he was caught by the same camera, surely he would of know to slow down for it   , the one that caught him 4 times is clearly visible - when its not been burnt out that is :exclamation:

WTF is a “victim surcharge” and who’s the “victim”? Surely not another way to get money out of the Ahem “Innocent” :unamused:  motorist. Lucky bugger he was.

Wonder if he’ll keep his job though, and if he doesn’t bet he wont get another.

It’s been around for about 5 years and it’s not just motoring offences. It is applied to every fine except fixed penalties at the moment, but that may change, and it doesn’t mean there was a victim in the case. It is always £15 regardless of the amount of the fine and it is paid into a central fund which is then used to help the victims of crime.

Not optional then?

It’s been proposed to raise this charge significantly in the not too distant future!

i got caught last year driving a car with no insurance as it expired 4 days before i was pulled it went to court at the begining of this month as i have 6 points on my license which i collected while driving HGV’S the judge wanted to give me 8 points the ■■■■*r,i was’nt to happy as it would cause hardship on my family so he decided to cut me a deal and give me a 28 day ban with no points
