sorry about asking again but seem to be having a bit of a difference of opinion with t/o, am i correct in saying i.e
start 17.30, finish 4.00, 10.5 hrs with 1.5 hrs break, i.e 9hr work[ that leaves me with 3 hrs work left in 24 hr period, so as i started at 17.30 on tues ican start 3 hrs before 17.30 wed [ 14.30] , giving me 12 hrs work in 24 hrs[weve signed opt out] , and 10.5 hrs break.
the transport office say because im a night worker and have signed the opt out ive got to have a 12 hour break i.e if i stop work 4.00 a.m wed im not allowed to start work until 16.00 p.m wed [ 12hr break]

the book ive got states on night work
the 10hr limit in a 24 hr period prevents a worker from proressively making earlier starts unless fewer than 10 hrs has been worked in the previous shift

so as weve signed a opt out to do 12, and ive only done 9hrs in the previous
shift i can start 3hrs before the 17.30 , 24 hrs are up :question:

12hr break? Load of bobbins. The same law applies whether you do days or nights (as you’ve opted out).

If you have started a daily rest period when you finished at 04:00 you can start again at 13:00 if you wish, 9 hour rest, or at 15:00, 11 hour daily rest. In other words you can start again any time after 13:00. The bit about ‘3 hrs work in 24 hr period’ makes no sense as regard the tacho rules, or the WTD.

what i was working on neil was the fact i thought under the wtd [ nights ] you were only allowed to work 12hrs in 24
i.e if i started at 17.30 on tues i could only work 12 hrs between then and 17.30 wed, so if i did 9hrs from 17.30 tues i would only have 3 hrs [ 9 plus 3 equals 12] left to do in my 24hrs[ or before 17.30 wed]
what your saying is as long as i have 9/10/ 11 hr rest im ok as long as i make it up[ 9/10]
so there doesnt seem to be any difference between nights and days :question:
