I work for a parcel company, currently doing a 19:30 start - couple of hours to first depot -tipped by depot -wait an hour or so to be loaded by depot (take a 30 min break while on door)- driving - tip manualy - rest (45 mins) - manualy load - driving - manualy tip -finish at 06:30 earliest.
is there a ten hour night shift coming into force 1st April
me and 2 other drivers at our depot are doing up to 12 hours some nights due to late connecting trunks etc.
Our depot manager keeps stating we can do 13 hours a night, up to 56 hours a week.
this dont sound right, I have read on this forum about a 48 hour average over 17 weeks, with 56 hours being the maximum in a week.
any help would really be appreciated.

For the purpose of the WTD 10 hour night rule the shift you outline above doesn’t exceed 10 hours. Although you have worked 11 hours breaks and POA do not count toward the 10 hours and it looks as if you have had 1 hour 15 mins of breaks, with possibly another 30 mins of POA depending how you book the other half of the 1 hour wait while being loaded.

No it has been in place for a year or so now, unless the drivers at your depot voted for the opt out.

If you are waiting for trunks to arrive you will likely be on break or POA so this won’t count toward the 10 hour limit so you will be okay with regard to the 10 hour night limit.

He is talking out of his arse. you can potentially do 13 hours a night, and up to 15 hours on 3 nights of the week. There is a weekly working maximum of 60 hours and an average of 48 hours over whichever reference period your company operate to, again breaks and POA do not count toward the 60 or 48 hours.

60 hours working is the maximum in a week. 56 hours is the new weekly driving limit which is being introduced on the 11th of April this year.

And the ‘opt out’ can be within groups of individuals within the workforce. Hence persons working a particular ‘contract’ or pattern, may wish and choose to put into place a ‘workplace agreement’ whilst another group might not.

maybe… dunno lol
all I know is we voted against as it meant that although we dont run nights we do start before 4am which puts it into the night workers catorgory…

I believe that is the case Coffeefolic - the workers have to vote for exceeding the 10 hours.
i have opted out of the 1o hour aggrement with my employer can i opt back in so i only do 10 hours a night ?
according to our contract you can opt back in but you have to give 3 months notice and your pay will be reduced pr-rata [ pay cut i think].

Yeah you can opt back in, you need to tell your managment & Personnel dept & sign something.

Is opting back in going to make much difference to the hours you actually work each night? Remember breaks and POA do not count toward the 10 hours, so even opting back in the time between the start and end of your shift can still exceed 10 hours.
