night time work for hgv drivers are between 00:00 04:00
I start my ■■■■ at 12:00 mid day and my employer will normally keep me in the yard untill around 16:30 then send me out on a 8 to 9 hour run finishing past midnight.
My contract is days and not nights do they have the right to do this?
Cheers.
Depends on exact wording of your contract but basically - as a general answer yes they can do that.
As with all employment law, if you don’t like it, raise a grievance in writing following the companys grievance procedure. If they have changed your conditions or your contract doesn’t allow this work then you either need to accept the changes and carry on or they need to make you redundant because your original job is no longer available. It is actually far more complex than this and I am generalising. There are legitimate ways a company can enforce contract changes on you or get rid of you.
The short of it is - if you don’t like it, go get another job or tell them you don’t like it and get them to compromise which a decent employer would do. Maybe they think you don’t mind.
Of course as a night worker you need to be aware of the RTD 10 hour working time limit.
Forgive me for being wrong but your sailing close to 13hrs each 24hours leaves no room for ■■■■ ups as your 12pm start time is the start of your working day not 16 30
I would tell them to ■■■■ the job or come back 10min to 1am park up and just go saying sorry out of working time

there aren’t many companies who work those hours, who would not have a workforce agreement in place to cover night time working for the WTD. They are normally in contracts of employment now, so when you sign that you sign the agreement as well.
The 13 hours is relevant to EU tacho regs and yes he could only run over that 3 times between weekly rests.
I feel its quite simple I’m not on a night contract, our night drivers get 3 grand more than me, if I’m out on the road at 00:00 I’m pulling over and have my 9 hours rest.
