No. Article 8.2 of 561/2006 says; Within each period of 24 hours after the end of the previous daily rest period or weekly rest period a driver shall have taken a new daily rest period…
Article 8.5 goes onto say; By way of derogation from paragraph 2, within 30 hoursof the end of a daily or weekly rest period, a driver engaged in multi-manning must have taken a new daily rest period of at least nine hours.
In English; within 24 hours of ending the previous daily or weekly rest, you must have another daily rest. The second paragrah basically says that for double manned vehicles you must have at least 9 hours rest within 30 hours of when you ended the previous daily or weekly rest period. There is no limit as to how many times you can do this in the week, just like there was no limit under the current (soon to be replaced) 3820/85 Regs.

Except that Paragraph 4 says:

A driver may have at most three reduced daily rest periods between any two weekly rest periods.

Paragraph 5 (which you quoted) states that it overrides Paragraph 2, but it doesn’t say that it overrides Paragraph 4. Maybe the “at least nine hours” is enough, but I think it’s open to interpretation (IMHO).

Perhaps we should congratulate them on managing to modify a 20-year old law and making it more ambiguous… :unamused:

Paragraph 4 doesn’t apply to drivers of multi manned vehicles, so long as they meet the criteria for multi-manning. As far as multi-manning is concerned there is no such thing as a ‘reduced daily rest period.’ Their rest requirement is simply nine hours in thirty. This is no different from the situation we have in the current regs (Article 8.2 of 3820/85) where it simply states that each driver of a multi-manned vehicle will have 8 hours rest in 30 hours. The 8 hours is not treated as a ‘reduced daily rest’ and can be carried out more than 3 times in a week

According to the FTA briefing, from Jan 2008 (20 months away) we’ll need to keep any analogue tacho charts for 28 calender days. Boy, this is going to be fun!

i have had a class one sorry cpluss what ever you like for 35 years ihave dibbled in the tgwu ,wast of time and at no time have i been asked what would improve my job .just who sits down and dreams this stuff up ,why do they make it so complicated, i like 30 min at about 8,45 then 15 min through out the day ,i am now finding i feel like abrake when i can not have one and have to take one when i dont want one ,walking up and down for half an hour killing time about half anhour before finishing .it must be nice telling people what hours are best for them then getting up from ther chair and going to the loo or canteen after starting at9 am had hour for lunch and finishing at4 pm we need a jimmy hoffer

They simply try and justify their £120,000 PA salary + Expenses by thinking up stupid changes, however, in all fairness a few drivers were responsible for the legislation changes because of their own stupidity by flouting the loop hole which let them drive 8 hrs 59 mins wirt only a 15 minute break, which prompted the big wigs to look into preventing it from happening by closing the loop hole

By driving for 1 minute, then taking 30 mins break they could then drive 4hrs 29 mins and take a 15 min break then drive a further 4.5 hrs, it was a case of drivers once again shooting themselves in the foot. The changes made it impossible to do that as they now need to take the 30 minute break after no more than 4.5 hrs so they always have a minimum of 30 mins break in 9 hrs.
