Heading back to crick i stopped at toddington to take a break.Now at this point Whilst using alot of poa i was actualy at 5hr 18min work and 3hr 10drive.
I decided to just have 31min to cover wtd rules and made it back to crick 4hr12min.

Clarify is that 8hr 28min before you took your break at Toddy ■■
If so I suspect your wrong as WTD is or was a break of 30 mins after being on duty for 6 hrs irrespective of the use of POA etc
I could be wrong and stand corrected if I am
I normally do a straight 50 min but with all the waiting around i did and short distance i knew if i could get back to crick within target 4hr15 ill i will just pop 30min
If you take Poa out of my nite…5 hours lol it ment work was 5hr 18 at services so well in on my 6 but not enough to make crick.where as drive time i had enough.

There’s a problem - If you’ve done 5hr 18min work and 4hr 12min driving you’ve gone over 9 hours total work by the end of your shift. Under the WTD rules you should have taken at least 45 mins break (which could have been taken in three 15 minute chunks, had you so desired) .

It’s usually best to take 45 minutes or an hour off in the middle of the shift.That usually covers most requirements and also gives you a full 4.5 hours driving time if there’s any hold ups.

5hr 18 work and 3hr 10 drive and PoA? Afraid you breached the rules 6 hours in. Should’ve had at least 15 mins by 06:30. If you did exactly 2hrs 29mins or more PoA then you’re golden.

Why on earth do that , the next thing you will be moaning about, you don’t get enough time to do the run, night work is easy to do why not have a break after 4hrs,? you say London, but it’s a big place, surely starting at 0030 you take refreshment with you.
So at the point of taking my break i have done 3hr 10 drive/2hr 8min other work both is work so total is 5hr 18min.
The rest of the time is poa as i was on a bay.
So to cover the wtd rule i just took 31 min to clear wtd and knew i only had 1hr 20 drive time available as my break would not reset that.
Got back to crick parked up on total 1hr 2 min.add that on to 3hr 10 i was up to =4hr 12 total driving so im fine.
Like i say for 15min u can just wait it out but i was being messed about so much i thought i just wanna get home.
This place where i went always keep You but yesterday was a joke.

if your total working time for the day was under 9 hours, then, it is legal

Total working time seems to be 6 hours 20 mins but certainly less than 9 hours so the 31 mins break covers the WTD requirements
No driving time break needed as driving time less than 4.5 hours
Avoid using POA and all your problems are solved.
Could just use break on the bay or other work if break requirements aren’t met then inform loaders that a break was required and they can either stop loading or allow you to return to the cab if one of them waiting room nightmares.
The criteria for POA use appears to have not been met so incorrect mode selection infringement. Doubt you would ever get caught though.
Course if your not paid for breaks then that’s a different story.

Who told you to use POA on a bay.
“Knowing the duration in advance” doesn’t mean that you must actually be told exactly how long you will be waiting/on the bay etc - if you are aware that it usually takes them two hours to tip, that will suffice. But as you say, GOK how that would be policed (unless you were daft enough to tell the VOSA man that you had no idea how long it would take).
Just re read the whole POA thing and noticed the phrase forseeable duration used so I suppose if it usually takes 1 hour to tip and they tell you its now going to take 2 thats fine.

Never used poa before i came to my current place but this is first job paid by hour.Before been on day rate.

Nope because you can use a break which in some instances mess up your day later
I believe theres only one example POA can help your day by reducing the need for a full 45 to a 30 if youve already taken a 15 earlier and constant use of break has cleared your driving to early. But for the sake of 15mins its never been worth it for me.
Others may differ as that 15 could be crucial if cutting it fine or wanting to get home.
