New EU legislation

in 2014 there will be a change to the RTD.
as we know at the moment the WTD, and RTD has been suspended.

but in 2014 there will be a very important, and significant change for the haulage industry regarding the RTD.
any travel to or from a work place will be regarded as other work. however, if this is on public transport not owned or operated by the employees employer, or contracted to the employer, then this will be regarded as a period of availability.
therefore as from 2014, travel to or from the workplace can no longer be regarded as rest.

fantastic when can i sign up for this as i only work about 25miles from where i live but if i was to use public transport would be 2 hours each way, so 4 hours a day less working, count me in

I just laughed at this copper but he showed me the rule in his massive law book. He then said I should be getting paid from the minute I leave the house. Lol

he’s getting a bit mixed up between tax law, and the law he should have been looking at.

There is no difference between agency and employed drivers when it comes to the tacho rules and the agency guy I am working with tonight no more has to record his journey from home to our depot as other work than I do. Neither of us will have to record anything on the tacho until we arrive at the yard and start work. If we were taking over the vehicle tonight somewhere than our yard the time travelling there would have to be recorded as work but that would apply to both of us.

So,OK-just for me to get this correct in my head.I live in North Wales,and work for a firm in,let’s say,the Midlands.I travel to the yard to pick the lorry up-no need to record time.Now- let’s assume I’m working for a N.Wales firm who,for whatever reason need me to pick a lorry up ,again in the Midlands,but this time parked in a factory yard or wherever.I now have to record my travelling time? :confused: Have I completely misunderstood or not?

Where a vehicle coming within the scope of the EU rules is neither at the driver’s home nor at the employer’s operational centre where the driver is normally based but is at a separate location, time spent travelling to or from that location to take charge of the vehicle may not be counted as a rest or break.
