New Driver and pulled by Vosa

Good evening all,
I was pulled over by VOSA yesterday on the M1. I was driving with an analogue tacho. It was an overnight job thurs/fri.
The VOSA officer wanted to do me for not putting the reg on the disc…albeit they saw me eject it and hand it to her!
Is that a bit harsh! I know I should of written it on it but as she saw me eject it surely they have some leeway■■?
Only been driving since last September and was as nervous as hell!

Nope you should have had it on there before you put it in. you could have put anything on it once you finished to evade prosecution. DVSA / VOSA are only doing a job you didn’t do the right thing , you’ve learnt a lesson and I bet you’ll do it right from now on

The fact is you could have written any reg on there at the end of your shift, had you not been pulled.

I got “done” for writing a ditto mark in the destination town, and end date, as i was on day work only. So that was 56 offences straight away  but as a newly qualified driver working for a company with a restricted operators license, VOSA quickly educated me

If that was the only problem, you’ll be just fine I’m sure. What you have to remember is they regularly encounter ■■■■ takers doing all sorts of iffy things, they have try and work out if you are, daft, uninformed, or a genuine dodger trying to play the system. So you will be treated as the latter until you can demonstrate otherwise through your actions/attitude…

Thanks for your 2 replies. I guess I knew the answer and basically you confirmed what I thought! I cannot deny I just thought it a bit harsh as Vosa saw me eject the disc and then hand it to her but still said to me that it could have been another lorry! I just felt there was no common sense!
And as you said…lesson learnt!
I appreciate your advice.

Ya own fault…Basic’s… So what they doing with you over it…Warning or a Fine

Just done a days cpc that partly covered this and was given the impression that VOSA don’t necessarily use common sense, also the most important thing is to protect yourself by checking everything is in order first.

Nothing to do with common sense it’s a LEGAL requirement

Never give VOSA an excuse to take your wages! :imp:

Polite, helpful and assisting VOSA with their duties is just common sense as well, you can’t win!

I know it’s a “LEGAL” requirement, if you read my whole post you’ll understand that

It was remark that VOSA don’t always use common sense I was implying to.

Rules are rules yes, but common sense and reasonable judgement of a situation are good qualities to have.

For newbies: This past thread here is a stop for an ADR load check.

Did you get a Fixed Penalty or court summons?

I’m not the OP mate.

Its not like your company timesheet/checklist where you can fudge it or do it the end of the day. Its a legal requirement as already mentioned so you have to do it. Yes she may of seen you pull it out but how does she know you didn’t just put it in 15 minutes before hand. You got a good ear bashing but no fine so happy days! Crack on drive, just don’t do it again!

Don’t imagine that this error is unique to rookies. I’ve conducted dozens of tacho cpc courses and a simple exercise is to complete an analogue chart. An amazing number of experienced drivers miss “start” information on the chart.

It is, of course, a legal requirement. But take heart, you’re not on your own by a long, long way. Chances are the OP wont make this mistake again!

Pete

DV$A are an organisation whose sole purpose is to raise money off drivers who break the rules. The reason for breaking them (not knowing, not caring or thinking they’re stupid) are irrelevant. Whilst you may get sympathy of fellow drivers for a newbie mistake, you’ll get none whatsoever off an enforcement officer.

Have you ever been stopped by the DVSA ?

On the rare occasions I’ve been stopped I’ve found them to be friendly reasonable and helpful.

Twice, once as a newbie and once a couple of weeks ago. Both occasions they were blunt, bordering on rude and obnoxious.
Occasion one (newbie) I had an intermittent light failure that I hadn’t picked up on during my checks. They practically called me a liar when I said I’d done them. Was satisfying when we walked round the back and they were working. Well, until they pulled at the wiring loom and “found” the loose wire. No fine on this occasion because I called fleet support who arrived and fixed it within an hour.
Second time I got pulled as part of a sting operation going out of Hull (about two weeks ago). They were pulling every curtainsider and flatbed going outbound and focusing on load security. I was empty, the look of disappointment when they opened my trailer up was amazing. From what I heard (rumour mill warning) there was a 98% non compliance rate that day.
IMO there has been a shift in attitude since they became a self funding organisation with revenue raising becoming the priority.

Me too - They always appear to be looking for the ■■■■-takers and chancers while offering words of advice to those who have made a genuine mistake.
