Need help, Dvrs Hours

Hi guy’s the other day I asked for some holiday and got a reply today, to cut the story short here is what I’m asking.

I work Monday to Friday 07:30 - 17:00 with 1hr for lunch, totaling 08:30hr working time a day, five times a week totaling 42:30hrs.
Every two weeks I work 04:00hrs on a sat. 08:00 - 12:00

My boss is insisting that transport says it’s legal for me to work 3 sat’s in a row, due to the fact that I don’t do that much driving in a week, so I therefore fall under the WTD and not driver’s hour’s rule.

I personally think he’s talking crap because he cannot get a relief driver for 4hrs.

Can someone (ROG?) enlighten me on this please?

What time do you start/finish on a Sat mate?

You haven’t said what time you do your 4 hours on Saturday, if you did 06.30 - 10.30 it would be legal as you’d still get 45 hours in before starting at 07.30 on Monday, any later than that and he’s talking ■■■■

also every day I probably only drive to a total of about 3hrs give or take (multidrop building materials)

You can work every Saturday if you like. Providing you are finished no later than 10.30.

What’s your contracted hrs and days of work ie m-f if so your not obliged to work any weekend

What about the weekly rest rules ■■? - I suppose boss just overlooked those because they did not work for him !!!

Every other weekend you need 45 hours off in one go - perhaps boss lost that bit of the regs :wink:

Thanks for the replys so fast guys, it’s exactly what I have been telling him that’s what I understood it to be, but he is insisting he has spoken with someone high up in transport department at our head office, and he said I’m ok to work it, so tomorrow i’ll ask him to get it in writing for me, before i work any saturday on the trot. (you and I know it will not happen!)

It just says on my contract I’m paid for 45hrs a week to meet the company’s needs and that is Monday - Friday 07:30 - 17:00 with 08:00 - 12:00 on Saturday but due to rest needed each driver (2 of us) work’s alternating Saturday so the company has a driver all the time.

The reason this has come about is because I want the Saturday off for holiday and transport wont hire an agency driver for 4hrs on a Saturday, and the greedy git thinks he will loose out on masses of money!

As you say I doubt he would be stupid enough to put something so ridiculous in writing anyway. I assume you already know that even if he did, VOSA would still hold you to account for insufficient weekly rest if you got pulled.

Indeed, I wouldn’t do it anyway, just call his bluff and watch him fizzle out, just wanted clarification before I start spouting stuff… nothing worse than making a right ■■■ of yourself eh?

The answers are above, you (assuming you are driving on a tacho at least - I’m unsure of none-tacho rules these days) definitely come under EU rules and require NO LESS than 1 reduced weekly rest and 1 regular weekly rest in a fixed 2 week period.

Now, there are times and ways of getting around the ODD 2 Saturdays in a row, but we’ll not go into that today. In your example, you need to either finish before half 10 on alternate Saturdays, or start after 9am on alternate Monday to stay legal

Is there a way that you and boss can agree to a 9am monday start every other week ?

Or perhaps every other week do job and finish on Saturday then start 45 hours later on Monday which could be for example
sat finish 1115 with mon start 0815 ?
