Need advice please hours driven and delayed

Yesterday i started a late trunk it would take 4 hrs 20 mins eachway.while going down the m74 there were 2 lanes shut for an accident. I was in a moving queue and my drive time was being eaten up by the time I managed to get near where I was stopping I had driven 4 hrs and 53 mins i couldnt find a safe suitable place to stop before that.
i did a print out and wrote that i was delayed on m74 for accident and was unable to find a safe suitable to stop later on in my journey.

Have I covered myself or will I get done for driving so long ,this is a one off .hence im asking for your wisdom?

I would have done the same in your position,you could hardly stop on the hard shoulder for your break,could you ?
As long as you wrote on the print out the reason why and it’s a one off,I can’t see a problem.

You have used Article 12 and that is correct, provided that you haven’t passed a layby or service area before you got

near where I was stopping

I would just watch your hours a bit closer and don’t push it to the limits,

I’d say what you did was the right and legal thing to do.

If your card is likely to be downloaded before the next 28 days do another printout complete with the same manual entry so you’ve got one to hand in and one to keep for the required 28 days :wink:

hmm where was this accident on the m74 since i went up and down it last night/this morning and didnt see anything

Junction 16 -19 m74 south bound arround 4.30pm one silver car on roof in third lane facing the wrong way

The Trunk was on the limit and I know it. no where to stop on dual carriageway.no laybys/service stations near suitable to stop
My return trip was 4 hrs 27 mins the road beside depot was shut so had to find other way in and fixed speed cameras keeping an eye on me :slight_smile:

I know that if i hadnt gone over my first period of driving i would have parked up for a break and used my 10th hour to get in :slight_smile:

ahh long before i went down the road then lol.

This really depends on where you actually ran out of driving time though, technically.

If you got to 4:30 driving in the queue, then you had no option but to carry on to the first available parking after it.
If you ran out of time say 2 hours or so later, you should have parked up and taken your break during that 2 hours.
As it’s a regular trunk and you know it’s tight for time, you would know you were going to be over due to the delay.
You would also know there was no-where to stop after a certain point on the run, so should have stopped where it was possible and then completed the run.

I’ve no doubt I would have done the same as you in similar circumstances, and almost certainly have done. I’m playing devils advocate here :smiling_imp:

had the same thing twice in 2 weeks
Once coming through Sailsbury NOT TRUCK PARKING and in Cornwall due to 4 layby’s being closed :angry: 2x printouts for both and copies for me and office…

When will the idiots realise that we need parking and not just layby’s
