Using another persons card is fraud isn’t it, just like in the old days if you pulled the fuse or did other stuff like putting a different date ect on the chart ■■

Don’t know about exempt, but there is some latitude given for animal welfare afaik.
Never looked into the rules as I would never in a million years do livestock, closest I came to it was running race horses down to Gatwick airport years ago, but I was accompanied by a groom who looked after them.

Think the animals lives are more at risk once they get to the slaughterhouse, not on the way there regardless of how many hours the driver has done.

But more seriously how would running under a false identity work in the case of a serious non fault road traffic incident resulting in casualties. :confused: I’d guess it would create a similar situation as drunk driving in that case.

Creating a false record to break hours regs seems to fit the description ?.

Judge Ian Lawrie QC told him he had put both human and animal lives at risk because he could have fallen asleep at any time and crashed his truck with disastrous results.

Think the animals lives are more at risk once they get to the slaughterhouse, not on the way there regardless of how many hours the driver has done.

I think carrying livestock comes under domestic rules, so you could use a logbook rather than a tachograph to record your hours. But whether it is under domestic or EU rules using another person’s card to create a false record is fraudulent.
Perishable goods (ie food) are covered by EU regs, but drinking water is another exemption which comes under domestic rules.

Unless he was a farmer moving live animals to slaughter or market within 100km radius of his base, he would be subject to full EU Rules just as though carrying pallets.

There are separate rules for carrying livestock, but these don’t generally overrule EU Drivers Hours Rules and the driver would be expected to adhere to EU Rules except in emergencies.

He may have only got £500 and a suspended sentence from the courts but he will undoubtedly have his licence revoked by the TC now guilt is confirmed. The TC’s guidance states they will revoke and disqualify for 12 months if there were 6 or more offences of falsification by failure to keep records. However - for deliberate falsification/forgery it is revoke and disqualify for 12 months for a single offence, longer for 2 or more offences.

I am also quite certain the Operator will be in front of a TC fairly soon as they have failed to adhere to the standard O licence undertakings.

Vehicles that are used to carry live animals between a farm and a market or from a market to a slaughterhouse where the distance between the farm and the market or between the market and the slaughterhouse does not exceed 100 km.

That’s the derogation, most will be EU
