Can I then move another truck or 2 onto bay in order for it to be loaded without it being recorded on a tacho is it legal or otherwise?

Technically you should use the card with the tachograph on “out of scope”, the time would be classed as other work.
If it’s just a matter of minutes and you don’t want to insert the card you could do a manual entry the next time you insert it, the time should be recorded as other work.
