Hi, regular lurker, irregular poster…I’m basically looking for some advice/reassurance for a close friend of mine…He’s petrified of being banned through totting up, he’s already got 6 points, but got flashed twice on the way to the hospital after being called late at night to say his father is taking his last breaths, and he needs to be there asap to say goodbye…Obviously nothing was gonna stop him getting there and he would do the same again…He drives for a living, so he’s worried he’s gonna lose his licence and job…I’ve told him to wait first for any NIP, then show the authorities the death certificate, and they’ll probably write it off…But TBH I’m not too sure, I was trying to make him feel better…But surely there is leeway for extreme circumstances like this, isnt there?

I would say it depends. He will probably still get done but they won’t remove his licence if he can prove such circumstances. Whether he’ll still be able to work with 12 points is another matter. I doubt they will ‘write it off’ to be honest. A DJ may decide that mitigation applies but that will not prevent him still being guilty.
Wait and see, and get some advice if that NIP arrives.

My X was being driven to the delivery suit by her fella they tripped 4 cameras he was bricking it but told him to do as above, they dismissed all prosecution. not saying he’ll get off but the more info you have the better.
They will take such things into account and he might get a result.
I would imagine he will get a ticket through the post and hae the chance to appeal it in court he would off been better getting caught by a copper my grandad was dying last year got a call he wouldn’t make the next hour, I grabbed my keys and off I went I wasn’t hanging about and a copper went passed and turned around gave me a tug just before I joined the motorway, 2 days before my headlight blew and I only had sidelight on n/s he pulled me for my manner off driving ie i was booting it and my headlight I explained my grandad was going to die in the next hour and he could phone the hospital and confirm this he saw I was sincere and told me to get going to say goodbye but to go halfords on the way home but to just make sure I get to see him and not be layed next to him after an accident there are some good ones about and I had the chance to explain maybe a trip to court and he may have an understanding judge. Once I moved forward when stopped at the red light to avoid being hit from the back. I received a nice picture from red light camera, so I went to court and explained the situation. Altough there was no evidence other than my car was clearly stopping just after the line (you could see three stop lights and everything) as the other car was outside the picture, they did believed me. The court said that altough I broke the law by going over the stop line, in such circumstances I am excused, so guilty, but free to go, no ticket, no points.
Lucky you, exact same thing happened to me a few years ago, still got done, they don’t give a ■■■■ just want £££ & to do people. The lights change so fast in the uk & cars/bikes can only just stop before the line, what happens in a fully laden truck…■■?
Don’t forget also being flashed doesn’t mean the camera is live.
Gather evidence as proof as mentioned. I would say the worst case scenario would be getting just the one set of 3 points if caught the twice

Maybe helpful was that the policeman who was testifying against me was a complete moron. He claimed that pictures are made 0.001 seconds one after another, which judging from the distance I covered between pictures made me travel something about 2/3 of speed of light And all that while braking
Even judge was laughing when I pointed this out
Such circumstances are an absolute defence.
You wouldn’t plead guilty with mitigating circumstances.
It’s a not guilty plea, then give the reasons. You don’t need to prove it, it’s up to the prosecution to prove you wrong.
