Misprint on seatbelt fixed penalty notice

got caught today in car with no seatbelt on in Livingston when i read the fixed penalty it said location Livingstone (note “e” on end)
is this valid should i pay £30 fine

if there have you address on there and that 's not wrong i would pay, cos if you leave it to long it will double

I don’t know how you would go about disputing it but that deffo seems like an excuse not to pay it. The FPN is inaccurate :wink:

take it to court and you will lose. judge will just fine you anyway cos its clear you wasn’t wearing a seatbelt in the uk.

My wife got an NIP the other day for last sat eve, 36 in a 30…

Shame she had only just gone the other way to collect kids so she knew van was there (We know by the time it was her return journey) On her way home, sat nav was saying 30 before she got to the 30 limit, yet the scamera van clocked her at 36, we have no choice (according to pepipo) but to cough up, and hope she gets driver awareness course, to say we are peed at an obvious scam, seems if you appeal the magistrates will go with NWP and not a sat nav, which should almost spot on…

If she gets the course she is gonna kick up big time there :grimacing: :grimacing: :grimacing: 1st offence in 30 years!!

AIUI they have a rule which means minor mistakes won’t invalidate the ticket, so I’d also pay.

A Fixed Penalty Notice is only an invitation to admit guilt and pay a fixed penalty without the need or costs of a court appearance, it’s not evidence in itself so minor errors are not really a get out clause. If you complain about the spelling mistake they will likely just issue a new FPN, which I believe they are allowed to do. If you contest it on the grounds of a spelling mistake and went to court there is something called Slip Rule which allows clerical mistakes, such as typos or spelling mistakes to be corrected.

can you really trust sat nav? my tacho says 56 my sat nav says 54 in the car theres about 5 mph difference help!!.years ago i got done in bournemouth 34 in 30 zone tacho showed 31 sent copy to dorset police and was told the gatso was correct and my tacho was faulty and if i want my day in court i was welcome.didnt seem it was worth the hassle all the way from london to attend when they,d already decided my tacho was faulty so i swallowed the fine and points. you live and learn :laughing: :laughing: :laughing: :laughing:

If the speedo in truck or car showed 31 and that could be proved by having it checked locally then there would be no penalty for speeding as it would be deemed that you were using the only info available to you.

If the speedo was faulty then that would be looked into and if a person was at fault for that then a prosecution for that might ensue.

To be honest, most speedos, when faulty, will read under and not over but there will always be the odd case…

Tail a flat out lorry in your car and I bet you’re doing 59-62ish on the car speedo and 54-56on the gps

So all the MLMs I keep catching in roadworks doing 45-46 actually think they are doing 50■■? :laughing: I have noticed that the truck speedo normally agrees with the GPS and the car one is about 10% under. N17 I would have been asking for the calibration certificate for the speed camera that got you.

If I remember correctly, it’s illegal for a speedo to under-read (read 30 when you’re actually doing 35). To prevent this possibility car makers have speedo’s made to over-read.
So this is exactly why all the MLM’s keep doing 45-46 in a 50 limit, because their speedo says their doing 50.
Wagons speedo’s are often calibrated during their 2 yearly check, so are generally much more accurate.

I did sent it back when Council London sent me a Fine over £120.- for driving at 05.00 on a banned Road.But there wasn’t a sign.
They wrote back it’s unaceptable,and i sent it back again applying for a hearing,and they cancelled everything.
But,if you pay,each Time is it registered.Once you have any big ,which goes to Court,and the Judge would say:“You did in that Periode so often against the Law!”
He wouldn’t make a difference between Speeding,Seatbelt,or what ever,in first Line.
But it’s on you what you find you shall do
