The WTD states that a driver cannot work/drive (not POA or break) more than 60 hours between any two sunday midnights

The minimum weekly rest is 24 hours

The max between any two weekly rests is 144 hours ( start at 11am sunday means the 144 hours is up at 11am Saturday)

You will have 21 hours to pay back unless you do not have to use that 24 as the weekly rest for that week

Presumably you had a regular 45 hour weekly rest period last weekend ?

having next two weekends off

If one of those two weekends off is at least 66 hours off then ok … but if not then the 21 hours payback will still be owed OR the second weekend off will likely be a reduced weekly rest to incorporate that 21 hours so the third weekend off will then need to be a 45 off

The fact that he’s having the next 2 weekends off does not necessarily mean it’s legal to have a reduced weekly rest period this weekend unless he had a regular weekly rest period last weekend, which I’m guessing he did but…

Generally you cannot have only reduced weekly rest periods in 2 consecutive weeks, legally you should have a regular weekly rest period at-least every second week.

It is possible to have reduced weekly rest periods on 2 consecutive weekends as a one off occurrence but to be sure whether or not it’s legal for you to have another reduced weekly rest period this weekend you would have to be able to trace your weekly rest periods back a few weeks, possibly to a time when you had at-least 69 hours off which was proceeded by a regular weekly rest period the previous week.

Alternatively if you can trace your weekly rest periods back to a time when you had at-least 90 hours off which would probably be a holiday weekend.

See if this post helps to explain it, in the image in the post the week prior to week 1 was a holiday week so the last 45 hours could be used as a weekly rest period for week 1, otherwise the reduced weekly rest periods at the start of weeks 2 and 3 would not have been legal.

Hi it’s complicated weekend of 8th Nov off all weekend w/end 15 Nov worked 10 hrs sat had 38 hrs rest this week end 22/Nov 24 hrs rest will finish Friday 27 Nov I’m off till Wednesday as holiday Mon and Tues not working next three weekends is that okay or have I breached thanks

Lets see if I have this correct …

week 1 - nov 2 to 8 = regular weekly rest
week 2 - nov 9 to 15 = reduced weekly rest of 38 hours
week 3 - nov 16 to 22 = reduced weekly rest of 24 hours
week 4 - nov 23 to 30 = regular weekly rest

ILLEGAL if that is correct because week 3 needs to be regular

CAVEAT - it may still be legal as a one off but to determine that we need to have all your weekly rests going back to the last time you had perhaps 90 hours off in one go including a sunday midnight

What time did you start on Tuesday 6/10

Going to out this in a way similar to my quote in this post …
week 1 - 7/9 to 13/9 = holls so regular weekly rests for weeks 1 + 2 as well as for the week 31/8 to 6/9
week 2 - 14/9 to 20/9 = regular weekly rest - see above
week 3 - 21/9 to 27/9 = regular from 45 off from 20/9 + 21/9
week 4 - 28/9 to 4/10 = need to know answer to question BUT assuming it was a total of 84 hours off then week 4 can be a 39 hour reduced daily rest with a 45 regular weekly rest for week 5
week 5 - 5/10 to 11/10 = regular weekly rest (see line above)
week 6 - 12/10 to 18/10 = reduced weekly rest of 41 hours from 11/10 period
week 7 - 19/10 to 25/10 = regular weekly rest using first 45 hours off from fri 23/10 at 15.45 to Tuesday 27/10 at  then assuming it was again 84 hours off the remaining 39 hours is a reduced for week 8
week 8 - 26/10 to 1/11 = reduced of 39 hours (see line above)
week 9 - 2/11 to 8/11 = regular using 45 off from end of week 8
week 10 - 9/11 to 15/11 = regular using the rest at end of week 9
week 11 - 16/11 to 22/11 = reduced using 38 hours off from end of week 10
week 12 - 23/11 to 29/11 = regular using the time off from Friday 27/11

As you can see the recent 24 hours off has not been used for any week so is an extra which does not need compensating for

I hope member tachograph checks my working out as it was not easy !!

PS - took me over 15 mins to decipher what was worked and what the rest periods were from the way it was given

I agree with this, it will be legal as long as last week and week 3 (27/09/15) were the only weeks you worked on a Sunday.

I haven’t calculated whether or not the compensation for the reduced weekly rest periods has been paid back, but given the amount of compensation needed it most likely has.

Week 1 … 07/09/2015 - 13/09/2015 … Holiday
Week 2 … 14/09/2015 - 20/09/2015 … Regular
Week 3 … 21/09/2015 - 27/09/2015 … Regular
Week 4 … 28/09/2015 - 04/10/2015 … Reduced
Week 5 … 05/10/2015 - 11/10/2015 … Regular
Week 6 … 12/10/2015 - 18/10/2015 … reduced
