Maximum working time per day

waynedl:
You can’t do 14.25 hours work either, because on a 15hr shift, you’d need more than just a 45 min break.

Why would you need more than one 45min break? The following doesn’t and is legal.

other work 3h
drive 3h
break 15min
other work 3h
drive 1.5h
break 30min
drive 3h
other work 45min

That adds up to a 15h shift with 45min of break.

Paul

Yes indeed that’s legal, but do we actually want to work a 15 hour day with only 45 mins break?

Except that after 3h other work followed by 3h driving you would need a 30 min break, not 15, to satisfy the RTD requirements. You’d then carry on as quoted but your total break in the shift would be 1h as you would need a further 30mins at the end of your accumulated 4h30 drive

Sorry but that’s not correct, you need a break of at least 15 minutes before exceeding 6 hours working time.

repton’s example is legal

No you don’t, as tachograph has said my example is perfectly legal. If you read the RTD there is nothing to say you must take a 30min break after 6h of work. It’s a common myth that you do, at least partly due to early interpretations of the rules by the ministry themselves being wrong

If their is no POA in those shifts then the figures change to 14 and 12 hours as there will be an extra 15 minutes break required for the WTD as their will be a second 6 hours of work in the shift.

Not necessarily. If the 45 is split into 15+30 correctly spaced then even without any POA you could do 14.25h of actual work in a 15h shift assuming the pattern of driving and other work allowed it.

Paul

Indeed you could, I couldn’t be arsed working it out, and I ignore the WTD anyway, so just guessed. :stuck_out_tongue:
