i plan to start driving at 02.00 tuesday drive 9 hours and park up at 12.00 if i take 9 hrs rest can i start again at 21.00 and drive for 4 hrs until 01.00 then another rest period or will i be exceeding the maximum driving in 24 hrs?
sounds ok to me but don’t fancy gendarme lightening my pocket by a couple of hundred notes

The daily driving time is the driving time between two daily rest periods or a daily rest period and a weekly rest period.
So as long as you don’t exceed the 9/10 hours driving between daily rest periods you’re fine.
There is no driving limit in the 24 hours it’s a driving limit between daily rest periods or a daily rest period and a weekly rest period 
The short answer is “yes that would be legal”
