M6Toll Leagle Side - Question

As the M6 toll is a privately owned road by a private company - is it cinsidered private land? Is it covered by the law and highway code as it stands? Cany you be done for speeding driving without undue care and attention etc? It’s not a happy thought.

yes of course you can be done for any offence.

sections of the A1, A50 and many other dual carriageways are “operated” or “maintained” by private firms.
this just means they sub out the whole maintainance/upkeep of the road to one company.
they are all still public highways, as is the M6 toll.

Me being a night owl and all pardon me if im wrong but ive been southbound jn 11 and its still coned off but the add,s on local radio is tellin me its open, maybe its a lack of daylight… :confused:

Dave, the government pay a charge for this road so it comes under their juristriction as it were. I’m arguing that as the company that owns the M6 set the toll’s it’s nothing to do with Blair (the thought only occured after a few glasses of wine so excuse the logic - but as I say it’s not a happy thought).

Because it is a public road it comes under the same laws as a normal road. I can’t remember it word perfect, but a road is simply defined as any highway that the public have access to. So yes you can be done for any speeding offences, driving without due care etc, in the same way as you could be done for driving without due care in your local supermarket carpark.

I heard on the radio this morning that the toll is now completely open for use. As regards the policing I’ve wondered who will be policing it. Presumably if the normal cops are used the toll company will need to pay them or perhaps there is a M6toll police force. Not sure on this.

I think it is just the regular police for that area who will police it. On the M6Toll website it has this question and answer in the FAQ

Q: If I break down on the new M6 Toll, will recovery vehicles be on the road?

A: In the event that you need assistance you should use the emergency telephone to alert the Police, they in turn will contact your emergency breakdown service.

So that seems to say the phones are linked to the police and not to the company.

I’ve just been to ASDA they want to come and sit for an hour in our supermarket. They might up their arrest rates :open_mouth: :unamused: :slight_smile: .

the m6 toll road is a PRIVATE road but the public has access to it so the road traffic act applies.

there was a thread i started with traffic cop on the old forum which goes into it in more detail,but as i remember because it is a private road you cannot be done for having no tax whilst on it as the tax only applies to a “publically funded” road (although you will probably be re-stopped once you leave it if they really want to do you)

i received this email regarding the speed limit for the road, the question i asked related to the maximum speed for the road and if enforcement was done via a point to point, ie enter the motorway and the time it takes to travel to the exit will pinpoint the average speed travelled at, it doesn’t give information as to who operates any speed traps or cameras or who prosecutes speeders but i know that dartford crossing control monitor and prosecute speeding drivers over the bridge.

I can advise that although the road is privately owned we will have exactly the same legal requirements as a normal motorway. The road is monitored by a control centre although these are not for speeding offences and the limit is 70mph however when approaching a toll plaza the speed limit is restricted to 30/25 mph in the tag lane and of course if you stop if you are paying by cash or credit card.

The cost is the same whether you use one junction or use the full 27 miles of motorway.
