I think the point about passengers is very valid. I witnessed an accident about 3am on boxing day night. I and a couple of cars stopped on the hard shoulder. The job I had trying to get a guy to move his car (with family in) in front of my truck in case someone ran in the back of him (everyone was going past at pretty high speed) was unbelievable. Surely a “professional” bus/taxi driver should be thinking about his passengers safety and that a live lane is not a place to stop if the hard shoulder was available?
This is a good point about the minibus drivers duty of care to his passengers - we’ll probably never know why he did what he did in stopping right there - would guess most if not all his passengers would be asleep at that time of day on a boring drag down to the city.
Why he didn’t simply move over to lane two? If any of the survivors are called it will be interesting to hear what they have to say - Mr Joseph may have commented about what was happening.
Maybe there needs to be a bit of research into collisions that occur where a vehicle has failed in anyway to slow or take action in these type of circumstances. There was a coach driver on a dual carriageway down here who ran into the back of a police car with the blue lights on (and we all know how bright they are) at full tilt even though it was visible for about 500 metres, at the same time of night.
I too would have stopped on the shelf and grabbed my phone and hi-viz and gone back to the AIM truck - could have been a medical episode etc.

What I would like to know is why neither of the two lorry drivers who sounded their horn not dial 999 and report. That 10 minutes could have saved the deaths.
Whenever I see a dangerous situation on the road - had one yesterday where a broken down black car, female driver in the near side lane of a dual carriageway, no hard shoulder and getting dark - immediately I rang Police Scotland. Could save someone’s life.

The minibus driver stopped in a live lane behind a stationary vehicle. I’d agree that looks like bad driving.
I don’t think it’s as bad as stopping in a live lane to sleep off a few cans of cider.
Nor is as bad as ploughing into a stationary vehicle in the slow lane.

The one thing I cannot get my head around is why did the minibus driver come to a stop,I mean when your catching something up your right blinker goes on and into lane two you go,am I right in thinking the AIM guy didn’t have his hazards on but did have his lights on so from a distance it would look like a slow moving vehicle which was been gained on quickly and you’d move over to overtake which is what the 12 mins worth of previous traffic probably did…
I’m not putting any blame on the bus driver I just can’t understand why he ended where he did…

He ended up where he did because the Fed ex driver pushed him there prior to that he had stopped and him and the others that are deceased probably would still be alive.to use your logic why did Fed ex driver not just sling is right indicator on and go round the scene as others had done. Oh wait a minute by his own admission he was at fault.

So just to get this clear. The minibus driver, with passengers on board, stopped behind a stationary vehicle in a live lane one, when Lane 2 AND the hard shoulder were available.
That’s fact. It’s in the court report.

I’m not deflecting blame here, the other 2 drivers are guilty as far as I can see. But if the bus wasn’t there then the Fedex truck runs into the back of the AIM truck and Fedex man is probably dead.

Because the majority of drivers can’t see beyond their bonnet. Probably never even realised it was stopped until on top of it. No forward planning or anticipation.

Perfect? No. Able to make decisions based on what’s safe and appropriate to do in the event of approaching a stationary vehicle on the motorway? Yes.
I don’t blame the minibus driver. He was alive until he was rammed from behind.
