Lousy POA

Hi all,
im asking for clarification on POA, there are plenty of examples about what POA is, and what isnt POA,
however there is very little is how to apply POA to WTD in order not to get infringemts,

Is it correct that 2 hours worth of POA means you can stretch WTD to 8 hours ?

Can POA help with the 10 hour night rule as in stopping the clock to keep WTD down to 10 hours ?

I do understand that POA is not BREAK,

If I just use break mode instead of POA would this help keep my WTD down ? Or would it count as WTD after i had taken the required 45 mins even though ive recorded say 3 hours break ?

is there any literature that can that explain points raised ?

POA is not working time. Therefore if you start at 06:00 and work solid for 5 hours and then take a POA of 2 hours until 13:00 you could resume work until 14:00 and you would not have exceeded 6 hours of work. You could now go home having no breaks at all.

Break also doesn’t count as work.

POA pauses the work clock. BREAK resets the work clock

Personally I would avoid POA where possible unless I felt it would benefit me.

unless there is a company thing that says you must use POA or you do not get paid for recorded breaks then I would not use POA at all and simply use break when not working or driving

i drive for a theatre tour. I start when the show finishes (around 11pm) and the truck needs loading. Usually leave around midnight to the next theatre but stop on the way there because a nice hotel room with a shower and a nice big double bed to get some zzz’s :slight_smile:

At that point I put the tacho on POA as its usually around 5-7 hours before I move again so
If I was to put it on break would that not come up as an insufficient break infringment?

If you record that 5 - 7 hours as break you can count it as a split daily rest and only then need a minimum of 9 hours with the 24 hour day

As it is I just don’t get why you are recording POA when you are clearly resting

I just bung it on poa here ,there and everywhere these days ,just for a quite life
