Sad story,
Sompthing i was thinking about if the load had fallen off and by chance not hit the cyclist do you think the driver should/would have still got the same punishment?

I expect they’ve just calculated that the metal container is sitting on the greasy metal rails of the trailer, and to get 8.2 tonne of sideways restraint needs about 40 tonnes of vertical load - i.e. 40 x 1 tonne straps. (Although the container provides 8 of this, so maybe you only need 32 straps…)
This is of course the prosecution making their case as dramatically as they can, but it’s pretty clear which way the wind’s blowing here, and people carrying non grippy things on flatbeds are going to be expected to be using mats.

I think the 40 straps were a bit of red herring brought into the original post
a fool for pleading guilty. accidents happen, and people make mistakes.
Its amazing, and when i started in this industry many years ago, i was contracted to various companies and one of them was Freightliner. We had 27ft single axle trailers,and the odd 33ft tandem as tandem had not been around long, all the trailers had raves on, and the 30 ft freightliner had to be roped on, there were no twistlocks ( hadnt been invented ) neither had ratchet straps, and if we were lucky, managed to get hold of the odd chain and toggle.
Considering the weight of the container ( all were open ) plus the load of steel coils, put us in a precarious position, but the dept of transport wasnt that interested in those days, we virtually did what we wanted without hinder or hindrance, including the hours we worked ( log books )
The driver involved in this terrible accident, and the laws and rules in place today, should never have happened. he should know that, he should have the experience to know his load was not safe, should have used more straps, and ropes if needed. We have all taken risks before, maybe some still do, like the guy on the M25 yesterday with 2 portacabins on, hazard lights because they were over width, yet insisted on overtaking everything in his sights, and the view i got of his mirrors, i believed he could not have possibly been able to see, i flashed him in but was ignored.
Unlike caravan transporters, who have extra mirrors to view the lower portions of their load, at least they have some vision,
And this poor woman has lost her life because of his ignorance, god bless her and her family.

With 40 straps mentioned in the BBC news, it makes me think the prosecution may have been reading theses forums when HomoFaber posted about the BAG by saying if BAG say it needs 40 straps, then you are not going anywhere, next to an overstrapped load on a flat trailer.
It doesn’t bring the lady back but maybe the sentence was a bit harsh considering the load was strapped, but no antislip was used

And that is why there is another loooooonnnnng thread about why Vosa are looking at load ‘restraint’ or lack of in way too many cases, however much you hate ‘authority’ limey and are genuinely happy for people to be killed and held up due to lazy/poor load restraint (that’s why this should be in the vosa/load restraint thread) on a fairly regular basis things won’t change.
But won’t you may not know about is the amount of all the data/statistics/intelligence gathering work that is being done & linking all the ‘accidents/mistakes’ together to reduce them.
I don’t really have a problem with it, decent operators probably won’t have a problem with it, family/widowers of deceased probably won’t have a problem with it, those who want to work on the ‘edge’ of the law & responsability probably will
