That’s not entirely true - you appear to be mixing up two concepts.

“Hearsay” is not admissable as evidence for a case. i.e. if Fred Bloggs is being prosecuted for stealing a car, then “Joe Normal told me that Fred Bloggs stole John Doe’s car” cannot be used as evidence against Fred Bloggs.

However, if Fred Bloggs can prove that Joe Normal has been telling people that he stole John Doe’s car (and, in this case, he appears to have a witness which testifies this), and that Joe Normal knows this information not to be true (or, at least, has not made reasonable efforts to prove its truth), then Fred Bloggs can sue Joe Normal for Slander, Defamation of Character or Libel, depending on the exact nature of the information and how it’s being spread.

There is a big difference between TNUK and a chat in a cafe:

  1. The owners of the cafe are not liable for what its customers say [1], because the cafe owners are not the people publishing the information. The owners of TNUK are liable for the information published on the TNUK website, because, in the eyes of the law, the website owners are the publishers of the information. The law in this area hasn’t really caught up with the reality of internet message boards yet.
  2. The number of people who can read TNUK is much bigger than the number of people who will be listening in on a cafe conversation. This can make a difference legally, and the amount of damages can be higher.
  3. It is easy to prove what is posted on a website. It is more difficult to prove what is said in chat in a cafe, unless you start going around bugging people’s conversations.

[1] although there are some limits to this - for example, if the cafe owners were to allow someone to hold meetings where they were spreading misinformation to groups of people, there might be some grounds for action there.

not to hijack the thread, but whilst we’re on this subject. I wonder if many of you are aware that P & O Ferrymasters fleet of own trucks has been reduced by 40+% over the past few weeks?

Talking to one of there drivers last week who was loading out our place he was saying that 50 got payed off ! just in Scotland/Ireland! Bad sign if a big Co like P&O are struggling ! :cry:
