It is hardly a grey area. The limiter has to be set at 90km max . The tachograph is and always has been calibrated in Kilometres.
The 60 mph speed limit is not the target, neither is the 70mph for other vehicles. No one is forced to drive at 70mph on a motorway.

I say again the Highway Code quite clearly says the maximum speed for LGVs on a motorway is 60mph. What part of this is unclear…![]()

Motorway speed limits
It is likely, once all the changes to vehicles requiring road speed
limiters have taken place (after 1 January 2008), the national
motorway speed limit for goods vehicles over 3.5 tonnes and
buses will be lowered.
Restricting all vehicles in these classes to the same speed limit will
reduce any competitive advantage of older vehicles (which are not
required to have speed limiters).

Well I don’t think buses have been lowered as I went down to Spain from the UK in August this year on a coach and flew past all the lorries. So buses are still 62mph/100kmh. We also flew past NL, F, E, IT, P, D etc. lorries through France.
The 55 plate Transit minibus I used to drive was delivered new was unlimited. Then when it came back from it’s first service and was limited to 100km/h. This was before the deadline date. As far as I know almost all buses now are 100km/h limited.
All the trucks I’ve driven over here have had properly calibrated and functional limiters. Calibration ticket reads 85km/h, but often set a 89km/h. I can think of a few companies that have a dead-on 85km/h cruise and top limits. Nightmare to drive, so they are!
