I know this is a older video but does anyone know the actual law regarding this?
Personally, I think he was parked in a stupid place. Moronic place to take your daily rest.
I also think the police can make you move if you are parked on any highway (public road).
You have to stop in the 1st safest place possible.
And we all see safe as different.i guess.
What the driver deems safe and.dvsa see as safe are different.
Personally should.get a ticket. As he has obviously just come.off a motoway and parked up . Surely he went past a services along the route but decided to drive right to the limit.
Are we guessing it may be past the end of motorway signs but still on a clear way. So drive to the limit, passed other options to just pull up where he fancies. Didn’t bother going through it all. Perhaps If I’d been the police, would be to come it and be back at 10.55 and just happen to check tacho etc.

Quite an old video. He’s parked past the ‘end of motorway regulations’ sign so he’s not breaking motorway rules cos he’s not on the motorway. He’s not on a slip road, it’s a council access point for gritters and other council vehicles. It’s also used for wide/long/heavy load parking.
It isn’t the best place to park and I wouldn’t park there myself.
My feeling is he’s parked there because he knows he can argue his point with confidence against plod.
It’s been double yellow lined since this incident which tells me, he was in the clear.

The point is the police have the power to ask you to move. His argument of (I’m on my daily rest so I can not move) is irrelevant.
Even in a MSA you can be asked to move buy the owners and you have no recourse other than to do a print out explaining it.
Now correct me if I am wrong here but the rule is
If you are on public road the police have the power to move you.
if you are on private property the only have the right to ask you to move.

Second one in breach of HC Rule 243 - DO NOT stop or park opposite or within 10 metres (32 feet) of a junction, except in an authorised parking space". Not the brightest spark parking where he is which is potentially blocking someone from pulling out that junction because of the narrowness of the road they’d be turning left into.
Both perfectly avoidable if you don’t try to run the tacho to the last minute before stopping for a break.
