Legal or not??

2 hours other work
15 min break
3 hours driving
30 mins other work
45 min break

would driving clock then be re-set after the last break if i had only had 30 mins as ive would of had 45 mins break in total all though only 30 mins of it was while driving??, i had this situation today and i decided to sit and have the extra 15mins to be on the safe side as remember something on here similar were the vosa guru said it would be hard to justify at the road side…

Article 7
After a driving period of four and a half hours a driver shall take an uninterrupted break of not less than 45 minutes, unless he takes a rest period.

This break may be replaced by a break of at least 15 minutes followed by a break of at least 30 minutes each distributed over the period in such a way as to comply with the provisions of the first paragraph.

thanks ROG, so VOSA wouldnt see it as only having 30 mins break afer 4h30 mins of driving time? because the 15 mins was taken before any driving commenced.

Sorry mate - I missed that !!
YOU are correct - a break from DRIVING can only be taken once some driving is done which is usually at least 1 minute as any less MAY NOT be recorded

I apolgise again - I had been reading the RT(WTD)R a short time earlier and had that on my mind.
