legal or not?

start shift at 08:00 insert tacho
30mins other work for vehicle checks
08:30-08:45 15mins break waiting for load and having a brew (note no driving has been done during the shift)
08:45-1300 4hrs 15mins drive.
could you then only have a break of 30mins and drive for another 4.5hrs ■■?

I don’t think you can count breaks in advance for driving time but I’ll wait for a GURU to confirm or refute that

No you can’t do it.

No is the short answer.

The long answer is that the 45 minute break has to taken after no more than 4.5 hours driving, alternately the break can be split into two parts the first of which must be at least 15 minutes and the second part of the break must be at least 30 minutes, a split break should be distributed over the driving period of no more than 4.5 hours driving.

no mate you have to have 45 min after 4.5 hours of driving and as you have driven 4 hours and 15 mins you could take the 30 min break but if you start driving you would have to stop in 15 min and take another 30 mins break

Drive the vehicle round the yard for 1 minute after the 30 minute check period and before you have the tea break and then you can just take 30 minutes after the 4 hours 15 minutes driving followed by 4.5 hours driving.

What a difference a minute makes.
