I’m self employed, but as a sole trader (I don’t do enough driving to warrant Ltd Co.), and I was also on PAYE with one agency until the end of last year. I’ve received work from the agency I do S/E work for, but not had a thing from the PAYE lot, so that implies they are not interested in using me. Both agencies supplied larger companies and it didn’t make any difference to them last year, but obviously things may have changed with AWR.
Self employed through my Ltd Co - do work for various companies & agencies, have found that the agencies now seem to prefer s/emp drivers and actively encourage use of these umbrella companies.
I find to that agency’s are trying to make you go the self employed route.
ADR Doncaster told me if I went payee with them the likes of tesco would
only give me work for about 11 weeks said its a government law they bought
in for agency workers and that even though the likes of tesco say 11 weeks
ADR said its more like 9 weeks.
This to me sounds like there trying to scare people in to going that route but
I could be wrong. Also other agency’s are wanting you to go self employed ect
but do sign you up on the employee route but try getting inductions in to the
big companies they don’t seem to come up.
How you finding going the self employed route?

No, it’s not scare tactics, Tosco have told my agency that they will only accept Ltd Co. drivers or Swedish Derogation (which the agency aren’t doing) & as far as Tosco is concerned it’s up to the agency to sort out, they don’t want to get involved with figuring out if a driver has been with them for more than the 12 weeks AWR limit.

Toscos don’t get involved in the 12 week ADR limit, as they aren’t employing the driver, the Agency are the employer and as such become liable - but the effect is that the extra costs of the 12 weeks ruling will have to be passed up the chain by the agency to Toscos etc, which they won’t want to pay, so if an Agency can fill their books with Ltd Co / S.emp drivers they can keep costs down.
self employed and there is no way i would take a full time driving job from the client. more money and i have my own truck (part of the deal i was offered) so its all good. i work a 5 day week with a night out every sunday, pretty much a set route or at least the same areas every week and i dont have the drawbacks such as having to ask for holidays. i wish i had done it years ago and i am now considering going limited company and VAT registered
whats it matter if they do cause you’ll never find out.
